Will of Jeptha Massie/Massey

In the name of the Reverent Father of all.
Item 1st:
I give and devise to my beloved wife in lieu of her dower, the farm on which we 
now reside. Situated in Mason Township, Lawrence County, Ohio, containing about 
one hundred and twenty acres, during her natural life and all the stock, 
household goods, furnature, provisions and other goods and chastles? which may 
be thereon at the time of my decease during her natural life as aforesaid. She 
however selling so much thereof as may be sufficient to pay my just debts. Also 
to collect and receipt against all claims due me. 

At the death of my said wife, the real estate aforesaid and such part of the 
said personal property or the proceeds thereof as may then remain unconsumed and 
unexpended.  (This seems to be an incomplete writing, but this is the way the 
Will reads). 

I give and devise to my fourth son, Dennison, a certain black horse upon the 
farm and the only gelding now upon the farm.

Now at the death of my said wife, I wish all my property be divided equally 
between my children with this exception. Each and any one shall  have fifty 
dollars more than my first son, Eli has. I have already given him fifty
dollars.

Now if my beloved wife, after my decease, from the proceeds of the farm can 
raise or purchase a horse for each of my three youngest children, I wish her to 
do so.

I also request that my two sons, Robert and Dennison cultivate the farm on which 
we now reside and give to there mother one third of the proceeds of the same. I 
also desire that Elisabeth Jseen?, who has lived with us for many years, should 
live with my beloved wife for company and have  her support off of the farm, 
during the life of my beloved wife.

I also request that my little niece, who we have raised, if she stay with my 
beloved wife until of age, to give her a bed and bedding and a cow and calf. 

I do hereby revoke all former wills by me made.

For testimony whereof I have hereunto set  my hand and seal this the 6th day of 
June in the year 1855. Signed and acknowledged by said Jepthia Massie as his 
last will and testament in our presence and signed by us in his presence.

The Testimony
The State of Ohio, Lawrence County
On the 19th day of June 1855- personally appeared in open court before me, 
Fletcher Golden, Judge of the court of probate of said county at the court house 
in Ironton.  Thomas C. Tagg and John Roach of said county both of lawfull age 
who first being duly sworn according to law, make oath and say respectially that 
they are subscribing witnesses to the last will and testament of Jepthia Massie,
late of said county, deceased and that the paper here produced and hereto 
annexed and perporting to be the last will and testament of said Jepthia Massie 
deceased was by said Jepthia Massie signed in presence of these deponents
and that the said was signed by these deponents as witnesses in presense of said 
testators and at his request and that the said testator at the time of executing 
said will was of full age and of sound mind and memory and not under any 
restraint.

Sworn to before me and subscribed in my presence the day and year first above 
mentioned.

Jepthia Massie Will, Vol 1, Page 201-204
 
Lawrence County Court of Probate held at the Court House in Ironton on the 19th 
day of June 1855. In the matter of the last will and testament of Jepthia 
Massie, deceased.

The last will and testament of Jepthia Massie, late of Lawrence County, deceased 
was this day produced in open court by Lucy Massie, the executor by implication 
(so considered by the court) in the will named and there upon appeared in open 
court. Thomas C. Tagg and John Roach, the subscribing witnesses to said last 
will and testament and on oath testify to the due execution of said will, which 
testimony was reduced to writing by me and  filed with said will and it 
appearing to the court from said testimony that said will was duely attested and 
executed and that the said testor at the time of executing the same was of full 
age and sound mind memory. Not under any restraint. It is therefore ordered by 
the court that the said will and also the probate and testimony aforesaid be 
recorded in the book of Wills.
