Georgia, Pike County

In the name of God, Amen.

I, Nevel Smith, of said State and County, being of
advanced age but of sound and disposing mind and memory,
knowing that I must shortly depart this life, deem it
right and proper both as respects my family and myself,
that I should make a disposition of the property with
which a kind Providence has blessed me. I do therefore
make this my last Will and Testament hereby revoking and
annulling all others by me heretofore made.

First, I desire that my body to be buried in a decent and
Christian-like manner suitable to my circumstances and
conditions in life: My Soul I trust shall return to rest
with God who gave it, as I hope for Salvation through the
merits and atonement of the blessed Lord and Saviour,
Jesus Christ.

Secondly, I desire and direct that all my just debts be
paid without delay by my executor herein after named and
appointed

Thirdly, I give, bequeath, and desire to my beloved wife
Rebecca Caroline, all my property both personal and real
estate, with all the rights, numbers and appurtenances,
to the same in anywise belonging, free from all all
charges and limitations whatever, to her own proper use
and benefit and behoofs forever with full power to
dispose of the same by will or otherwise, as she may deem
proper.

Fourthly, I hereby constitute and appoint my beloved wife
Rebecca Caroline Executrix of this my last Will and
Testament, this November 16th 1875.

Nevel Smith


Signed sealed declared and published by Nevel Smith as
his last Will and Testament in the presence of us the
undersigned, who subscribed our names hereto in the
presence of said testator at his special instance and
request this November 16th 1875.

Pike Court of Ordinary
February, Term 1877
The Will of Nevel Smith being produced in open court for
probate by the executrix, who has filed her petition to
prove the same, and one of the witnesses to said Will, R.
Y. Beckham, having subscribed the following affadavit
endorsed on said Will, February Term 1877, of Pike Court
of Ordinary, came into open court, at this regular term
of Court, R.Y. Beckham, and being duly sworn deposes and
says that he saw Nevel Smith sign, seal, and heard him
publish and declare the foregoing instrument to be and
contain his Will and Testament, while of sound disposing
mind and memory; that he witnessed the same for him, at
his request, and in his presence, and in presence of the
other witnesses, and that the same was executed
voluntarily by him, without compulsion, on the day it
purports to have been executed. And he further says that
he saw George W. Reaves and Elsberry Kent sign the same
as witnesses in his presence and in presence of Testator.

Sworn and subscribed before me in open court, February
5th 1877.

I, Rebecca C. Smith, do solemnly swear that this writing
contains the true last Will and Testament of Nevel Smith
deceased, so far as I know or believe, and that I will
and truly execute the same, by paying first the debts and
then the legalities contained in said will, as far as his
goods and chattels will thereunto extend, and the law
charges me, and thus I will make a true and perfect
inventory of all such goods and chattels, so help me God.

Sworn to and subscribed before me in open court, this
February 5th 1877.
