       P. R. NICHOLS deposed he had never been a member of the firm of 
       FERRY & NICHOLS and asked for return of a boat, tackle and
       fixtures attached in the case.  Case file contains a four page 
       inventory made by Sheriff George SMITH with assistance  of A. J.
       Morrison and James ELKINS.  It was written on stationary headed
       "City of Purcell Saloon"         W. W. MONTGOMERY, PROPRIETOR 
       ---Fine Wines, Liquors and Cigars---Lexington, Oklahoma Territory.
       The inventory included all items found in the saloon and one boat 
       or house.  [Apparently the boat was a saloon on the South Canadian 
       River between Purcell, I. T. and Lexington, O. T.] Philip NICHOLS, 
       W. H. CARR and ________ TANNER were called to give evidence on the 
       part of plaintiffs and W. W.  MONTGOMERY deposed that he had a
       contract with R. M. NICHOLS to rent the boat from 24 April 1891 
       to 24 December 1891.  T. W. MARTIN signed on the undertaking bond.

       dated 01 April 1894, ordering Sheriff SMITH to deliver certain

      Plaintiff stated that he and defendant were lawfully married 30 June
      1887 at Topeka, Kansas, and up to about the fourth of September 1890 
      resided together as husband and wife at which time she did abandon
      and desert plaintiff and return to Kansas.  Plaintiff asked for care,
      custody and control of their two children, Clarence E. SMITH and 
      Harry L. SMITH, and  also asked that the defendant be enjoined from 
      having or claiming right, title or interest in household goods, a 
      span of mules and farm machinary and the SE quarter of Section 32, 
      Township 11n, Range 2w in Cleveland County.  He stated he had been 
      a resident of Banner Township of Cleveland Co. for 17 months and 
      that he was a resident of Lancaster, Atchison Co., Kansas, for one 
      year previous.  The defendant was presently residing in Effingham,
      Atchison Co., Kansas.  The plaintiff stated that he was 27 years 
      old last August 11th, son Clarence was 3 years the 11th day of July
      and son Harry Lee was one year old the 3rd day of May.  The defendant
      had taken the children to visit her family in September 1890 and
      would not return.  N. H. SMITH, father of John, gave his age as 
      51 and his mother, Martha J. SMITH, gave her age as 53 and also
      gave the name of another son as Perry SMITH.  A Mrs. Lizzie SMITH
      made a deposition for the plaintiff.

       City, Oklahoma Territory, by contending that COPLIN was in the
       Territory before noon on the 22nd of April 1889.  GRAGG'S 
       residence was given as Beef Creek, I. T. and the others lived
       in Purcell, I. T.  Also mentioned were J. M. STOVALL and 
       Press STOVALL.

      Commissioner, was summoned to bring records of the Commission to
      Court.  J. J. BRICE, J. T. WATTS, J. S. LOOFBAURROW and  Louis
      STREEVER signed with MAY on his appearance bond.

       a judgement made in favor of the firm of BACON & MARRINAN, doing
       business in Oklahoma County, and against property of FERRY & 
       NICHOLS, a firm consisting of Fred FERRY and Marshal NICHOLS. 
       Plaintiff stated he was not now nor  neither had he ever been 
       a member of the firm of FERRY & NICHOLS.  Suit claimed George 
       SMITH, as Sheriff of Cleveland County, had seized plaintiff's
       boat (known by the name "The City of Purcell" and situated at 
       or near the mouth of Willow Creek in the SE corner of the
       Territory of Oklahoma) tackle and fixtures at $500.00 to 
       satisfy an attachment writ in favor of the firm of Bacon 
       & Marrinan.  Summons were issued to Marshal R. NICHOLS and 
       W. B. MONTGOMERY to testify on behalf of plaintiff.  Also
       summoned were Fred FERRY, Mike BURKE and Jack ENRIGHT.

       judicial purposes per complaint) and sold to HOUSTON.  PATTERSON
       was living 6 miles east and 1/2 mile south of Noble at time of 
       suit.  Crops were retained by BOSTICK and valued by HOUSTON at 
       $350.00.  Defendant answered that jurisdiction of the case was 
       in County B and not in Cleveland County.

       defendant married about 1870 in Parker Co., Texas.  Further she
       asked for the custody of the following named children; Pinkney, 
       age 13 years; Lydia, age 11 years; Lillie, age 6 years and Isaac, 
       age 3 years.  M. B. CAMP made deposition that he was 55 years old
       and had known plaintiff and defendant since the opening of Oklahoma
       Territory, that defendant was a sot drunk and did not support 
       his family.

            Defendants had given bond for FAULK OPPENHEIMER & CO. in a 
            suit against the plaintiff.  Case was tried on 25 August 1891
            before Justice of the Peace M. A. HUNT in Justice Court of 
            the Village of Norman.  Judgement was in favor of the 
            defendant in said case who is the plaintiff in the current
            case and CHESNEY was attempting to recover costs and attorney
            fees in the amount of 19.90 on the bond given by the defendants.

            Plaintiff made statement she had been a resident of 
            Cleveland County for more than two years and that she 
            and defendant were married on the third day of October 
            1891* (see note below) and lived together until 09 
            February 1891 and at that time defendant did without
            cause wholly abandon the plaintiff.  The summons issued
            to Thomas R. ARMS stated that Eunity ARMS was seeking a
            decree of divorce and that her name be restored to ALLISON,
            the name of her children.  G. S. FRINGES, who gave his 
            age as 41 years, stated he had known both the plaintiff 
            and defendant since a short time before last Christmas.
            J. H. LeCRAY gave his age as 59 years and residence as 
            Section 1, Range 2w in Township 10n and stated he had 
            been acquainted with the couple for about 14 months.

       Plaintiff stated he had been a resident of the territory for 
        more than two years and of and of Cleveland County for more 
        than six months and presently resided in Walker, Cleveland 
        County, O. T.  He stated that he married defendant 27 May 
        1891 and that they lived together until 01 October 1891, 
        when the defendant abandoned plaintiff. Plaintiff named in 
        his suit Joseph MALONE, William  GYER and his brother, Matt 
        GYER. Morris CRONIN deposed he had known plaintiff for three 
        years.  C. E. TAYLOR made a statement that he had known 
        plaintiff for about 18 months and that defendant had told
        him she did not intend to live with plaintiff any longer.

        KLINGLESMITH wrote a letter to the Court dated 02 November 
        1891 in which he asked that the case be continued as he was
        unable to come at the time and he also wrote that Mr. BROGDAN'S 
        wife was thought to be dying.

       a wagon and double harness set and two cows with two calves,
       total value of $305.00.  M. E. MOORE presented a bill to the
       court for $15.00 for keeping the mules and cows for thirteen

       Plaintiffs claimed defendant had wrongfully taken and unlawfully 
       detained fifteen suits of clothing, valued at $237.00, to which 
       the plaintiffs were lawfully entitled.  GERSON and CITIZEN'S BANK
       of NORMAN by W. CRAWFORD, Cashier, signed on the undertaking
       bond.  Plaintiffs were non-residents of the Territory.  Sheriff 
       SMITH deposed that goods were formerly kept by Louis COHEN at
       Lawrence, Kansas, and purchased by plaintiffs knowing the
       said COHEN to be insolvent at the time and with full knowledge
       of outstanding indebtedness against said COHEN.  That said goods 
       were transferred by GERSON to Newton, Kansas, and afterwards to
       Norman, O. T. for the purpose to defraud creditors of the said 
       COHEN.  Sheriff SMITH asked that a deposition be taken from one
       Leo STEINBERG of Lawrence, Kansas.  Henry MARTIN made a deposi-
       tion in Kansas.  D. M. MARQUART was subpoened on part of the 
       defendant.
