    WILL and ESTATE PAPERS OF WILLIAM LANE

    Will of William Lane was dated 8 Jan 1732/3, proved 31 Jan 1732/3, recorded in Philadelphia Will Book E: page 216

In the Name of God amen, The eighth day of January In the year of our Lord one thousand seven hundred & thirty two/3,  I William Lane of Providence in the County of Philadelphia in the province of Pennsylvania, yeoman, being very sick & weak in body but of firm mind & memory, Thanks be given unto God therefore calling to mind the mortality of my Body & knowing that it is appointed for all men once to dye, Do make and ordain this my Last will and Testament (That is to say)-

Principally & first of all I give & Recommend my Soul into the hands of God that gave it , & for my Body I Recommend it to the earth to be buried in a Christian like & Decent manner at the discretion of my Executors Nothing Doubting but at the General Resurrection I shall receive the same by the Mighty power of God, and as touching such estate where with it hath pleased God to bless me with in this life, I give, Devise & Dispose of the same in the following manner & form.  Imprimis, My Will is, that all my just debts both by private & publick contracts, first being Lawfully proved so to be, and my Funeral Charges be duly observed & paid by my Executors. 
    Item - I do hereby give & bequeath for the use of the ministers that shall serve successively at St. James Church situate in Providence  about  forty two acres of land adjoining thereunto church.  Land shall be laid out as Commodious for a settlement as conveniently it may without causing much damage to the remaining part of my land, And the abovesd. Forty two acres of Land, Message, Tenement, Hereditament, appurtenances &  improvements whatsoever shall be & continuously by Virtue hereof to & for the use abovesd. from the Day of my decease thenceforward forever. 

    Item- I give and bequeath unto the present Minister of the Sd place of worship (to wit) Rev. Alexander Howie five pounds lawful money of the abovesd. province to be paid unto him or his heirs at the end of three months next from the day of my Decease.

    Item- I do hereby give & Bequeath unto my only son & minor Edward Lane all my Lands, Messuages, Tenements, Hereditaments, appurtenances, Improvements whatsoever which shall remain after my sd. Debts Devise & Legacy be paid & performed as above sd. to be freely & fully enjoyed & possessed when he arrives at twenty one years of age, thence forward by him his heirs & assigns forever, and Likewise I give & Bequeath unto my sd. son what shall remain of my personal Estate after my sd. Debts & Legacy be paid, to be enjoyed & possessed from the time that he is one & Twenty one years of as afsd. Thence forward by him his heirs & assigns forever.  It is my will, that the yearly rent & profits arising from the sd. estate both real & personal hereby Bequeathed unto my sd. son or intended so to be (otherwise than what shall prove necessary for his maintenance, if any be, & such Education as I shall hereafter direct)- shall be let out to the best advantage, until he arrives at the sd. age, all which such increase as well as principal shall be wholly to be for my sd. Son's use his heirs, & assigns thenceforward forever.

    - my will is, & I desire the same be observed & performed, That my sd. son shall be put to School to learn to Read English and Latin, so far as to be well vers'd in the grammar Rules, & so much of Arithmetick as shall make him Capable to keep a Merchant's Book, And when he is so far Learnt, I order that he may be put apprentice to Learn such Trade as he shall then choose by & with the advice & consent of his Guardiance.

    Item -it is my will that if my sd. son Dieth before he arrives to the age above Sd. that there shall be paid by Executors out of my sd. Estate Ten pounds Current lawful money of the Sd. Province unto each of my Brother James Lane's Children (wit) Christian & Hannah; & also Ten pounds of like money to Samuel Robeson, son of David Robeson, and Ten Pounds money as afd. to Each of William Adams's Children (Vis) Richard & Mary, which sd. Legacies shall be paid within, or at the end of two years next after my sd. Son's Decease, But in Case any or either of my legatees named in the eighth paragraph of this my will Dieth before the time herein specifyed for the payment of the sum or sums hereby by me Bequeathed, such shall remain unpaid, & shall be & continue to be with the residue of my Estate., And in Case my sd. Son dieth as afd. I do hereby give and bequeath my Lands, Messuages, Tenements, Hereditaments, appurtenances, Improvements whatsoever to be divided between my Brother Samuel Lane's children as my sd. Brother shall see meet, all which the sd. Estate both Real & personall (other than the legacies before bequeathed) they my sd. Brother Samuel's children shall freely & fully  enjoy and possess the same from the day of my sd. Sons Decease (provided he Dieth before he becomes to the age afd.) thenceforeward by them their heirs and assigns forever.

    I also desire that my well Beloved & Esteemed friends Mr. John Hearsley of the City of Philadelphia, Physician, together with Mr. James Bingham of the sd. City, Sadler, be Trustees of this my will, as well as to be Guardians over my sd. Son, to Order & Advise him in the affairs relating thereunto during his Minority. Also giving them hereby full power for absolute authority to demand, Compell & Oblige my Executors hereafter named to pay, perform, fulfill this my sd. will, according to the meaning Tenor & true Intent thereof.

    I do Likewise Constitute make & ordain my sd. Brother Samuel Lane & my Trusty friend & neighbour Henry Pawling of Providence to be my only & sole Executors of this my Last Will & Testament..... Declared by the sd. Wm. Lane as his Last Will & Testament in the presence of us the Subscribers (Vis) John Lewis, Abraham Adams, Robert Jones.

    Be it remembered that on the 31st Day of January 1732 the Last Will & Testament of Wm. Lane Deced was proved in form of Law & probate & letters Testamentary were granted to Samuel Lane & Henry Pawling executors therein named having first Sworn well & truly to Administer the sd. Deceased Estate & bring an Ind. thereof into the Reg. Generals Office at Philadelphia at or before the first Day of March Next, And also to render an Account when thereunto Lawfully
    Recquired.

WILLIAM LANE ESTATE
 Sept. 15, 1746
Petition of Edward Lane
- father William died on or about January 8, 1732 - made will  ­ only child, petitioner, Edward, then about 8 years old. Said William by said Testament, after a few Legacies thereby given, did bequeath to the Pet. the residue of his personal estate and of the same Testament did constitute Samuel Lane, now of this county and Henry Pawling, dec.[?] Executors. That Pet.'s father by his said testament did direct and order that the pet. should be instructed in the Latin Tongue and in Writing and Arithmetic until he was of an age sufficient to ---?--- [learn?] a trade and then should be bound an apprentice. That the said Samuel Lane did receive all the Est. of the said deceased and kept your pet. at Husbandry work [?] in his Service until he attained the age of Twenty one Years and during that time only caused the pet. to be instructed in Writing and Arithmetic. That in a very short time after the Pet. came to age the said Samuel Lane taking Advantage of his Youth and Weakness and the Influence he had over him by educating him in manner aforesaid did prevail on the Pet. privately to settle the accounts of the Estate and execute to him the said Samuel Lane some Writing concerning the said Estate the Contents of which your pet. neither knows nor can learn but which the said Samuel alleges is a general discharge of all the Demands of the Pet. against the said Samuel for the said Estate and the Pet. doth alledge and hope he shall be able to prove to the Court that the said Samuel Lane hath received of the said Estate upwards of Two hundred pounds more than he hath either accounted for or paid to the Pet.  Samuel Lane never rendered an account of his Adm. Citation to Samuel to render an account. . .so Samuel may be compelled by Court to pay Pet. what justly belongs to him."
