 James Elems last Will and Testament
I James Elems of the County of Mecklenburg and State of North Carolina being
of sound and disposing mind and memory do make and declare this my last will
and testament in manner and form following that is to say, First that my
Executor (herein after named) shall provide for my body a decent burial
suitable to the wishes of my relations and friends and pay all my funeral
expenses together with my just debts whatsoever and to whom so ever due or
owing out of the money that may first come into his hands as a part or
parcel of my estate.  Item I give and devise to my wife Melvina E. Elems the
Plantation upon which I now live, during her life or widowhood, and at the
expiration of her widowhood I will that the plantation go to  my two
children Martha E and William A.  I also will my other plantation containing
about 5 acres to be disposed of the same as to my wife Melvina E. Elems her
lifetime or widowhood to enable her to raise, school and cloth my children.
Item will my negro man Elem to my wife during her widowhood to enable her to
raise my children at the expiration of her widowhood to go to my two
children Martha E. and William A.  Item I will all the household furniture
to my wife Melvina E. Elems.  It is my will if my two children Martha E. and
William A. does not live to have issue of their own body that all of the
property willed to Martha E. and William A. go to Margaret Younts, daughter
of Eliza Younts (deceased) and lastly I do hereby constitute and appoint my
lawful executor to all intents and purposes to execute this my last will and
testament according to the true intent and meaning of the same and every
part and clause thereof hereby revoking and declaring utterly void all other
wills and testaments by me heretofore made in witness whereof I the said
James Elems do hereunto set my hand and seal this      day of May 1862.
 Signed Sealed and declared by the said James Elems to be his last will and
testament in the presence of us who at his request and in his presents  do
subscribe our names as witnesses.

James A. Elms died during the Civil War on June 20, 1862 at Camp Davis, Camp
Davis, New Hanover County, N.C.  James served in company H of the 11th NC
Regiment.  He enlisted on May 30, 1862 and died less than a month later.  He
is buried at Flint Hill Baptist Church, Ft. Mill, SC, and his widow is
buried beside her parents in an unmarked grave at Steele Creek Presbyterian
Church.
