Harmon WESTBROOK to Benjamin WESTBROOK, both of Jones Co., NC
11 Aug 1845

This Indenture made his the 11th day of August in the year of Our Lord One 
Thousand eight hundred and forty five, Between, Harmon WESTBROOK of the County 
of Jones and State of North Carolina of the one part and Benjamin WESTBROOK of 
the County and State aforesaid of the other part. Witnesseth that he, Harmon 
WESTBROOK for and in consideration of the love good, will and affections that I 
have for the said Benjamin WESTBROOK, my son his heirs Executors administrators 
and assigns all and Singular three tracts or parcels of land lying on both sides 
of Little Chinquapin and on both sides of Black Swamp pocosten branch, beginning 
at a Redoak on the north side of the Creek and runs with James Handley's LINE S 
17 E 148 poles to a Pine thence S 55 W 80 poles supposed to be Lewis SMALLS 
corner Pine, standing near or on the borders of Black Swamp pecosten then with 
said SMALLS line S 54 E 42 poles to HANDLEYS corner then S 76 W 36 poles to a 
Gum sapling then S 16 poles to a stake then N 59 W 28 poles to a stake then S 34 
W 12 poles to a Pine near the corner of GILBERT land then N 30 W 52 poles to a 
Stake then S 41 W 22 poles to a Stake then S 61 W 20 poles to a stake then S 12 
E 76 poles to a Stake then S 40 W 80 poles to a Stake then W 70 poles to a Stake 
then N 39 E 140 poles to a stake then N 8 W 31 poles to a Stake then N 66 W 32 
poles to Nathan B. WESTBROOKS corner then with the reverse of his line N 15 E 76 
poles to his corner Pine Stump then the reverse of his other line N 67 W 40 
poles to a Stake in his line then N 2 W 42 poles to a Stake Owen CONNERS Corner 
in John FORHAM'S line then the reverse of CONNERS line S 53 E 58 poles to his 
corner Black Gum near a path in the edge of a Branch, then with the run of the 
Branch to CONNERS corner Gum in a line of the GILBERT land, then with the line 
of the GILBERT land N 17 W 60 poles to a Pine and Bay in a pond then N 55 E 120 
poles to the beginning containing by estimation One Hundred and Ninety five 
acres be the same more or less together with all the Woods Waters mines and 
Minerals and appurtenances to the said land belonging or in anywise 
appertaining. To have and to hold to the aforesaid Benjamin WESTBROOK his heirs 
and assigns forever all and singular the aforesaid tracts or parcels of lands 
thats lying and being and lying on both sides of Little Chinquapin Creek and on 
both sides of Black Swamp Pocosin branch, doth for himself his heirs the said 
Benjamin WESTBROOK his heirs Executors administrators and assigns forever, but I 
the said Harmon WESTBROOK do reserve unto myself the liberty of getting any kind 
of timber that I may chose during my lifetime. And the said Benjamin WESTBROOK 
my son is not at liberty to sell or convey said lands during my lifetime and the 
said lands shall not be sold, or made sale of to satisfy any debt or debts in no 
case whatever that my son Benjamin has created or may create during my lifetime 
and his wife lifetime neither shall his life estate nor his wife's life estate 
be subject to sale in no case whatever without my consent and the consent of his 
wife Barbary Allen WESTBROOK. Whereas I do hereunto set my hand and seal the day 
and date above written.

Then the Execution of the forgoing Deed was proved in Open Court in due form of
