20 Sept. 1875

This Indenture made the 20th day of September A.D. one thousand eight 
hundred and seventy five between John T? HEATH and Casarine HEATH his wife 
of the County of Jones and State of North Carolina, parties of the first 
part and Joseph RHODES and Mary RHODES his wife parties of the second part. 
Whereas the said parties of the first part jointly indebted to the said 
parties of the second part in the sum of twenty five hundred for the 
purchase money of a certain tract of land as evidenced by five certain 
promissory notes described as follows: the first five hundred dollars to 
fall due January 1st., A.D. 1877. The second five hundred dollars to fall 
due January 1st, 1878. The third to fall due Jan. 1st., A.D. 1879 of five 
hundred dollars. The Fourth of five hundred dollars to fall due January 1st 
A.D. 1880. The fifth of five hundred dollars to fall due January first, A.D. 
1881. All of said described notes to draw interest at his percent until 
paid.
Now therefore this Indenture witnesseth that the said parties of the first 
part in consideration of the premises and in the sum of one dollar paid by 
the said parties of the second part the receipt whereof is hereof 
acknowledged doth grant, bargain and sell unto the said parties of the 
second part and their heirs and assigns forever a certain piece or parcel of 
land lying and being as follows in the County of Jones and State of North 
Carolina on the south side of Trent River adjoining the lands of William E. 
WARD and known as the MURPHY place contains two hundred and twenty acres 
more or less and conveyed to F. G. SIMMONS the 30th day of November A.D. 
1848 by Wm. C. MURPHY and Caroline his wife and William POLLOCK, Trustee and 
for a more complete description of said land reference is given to a Deed of 
even? date with this given by Joseph RHODES and his wife Mary. To have and 
to hold the aforesaid premises with the improvements and appurtenances 
thereto belonging unto the said parties of the second part their heirs and 
assigns forever. Provided always that if the said parties of the first part-
shall pay the said parties of the second part the said described notes a 
they fall due otherwise to remain in full force and effect that is it shall 
be lawful for the said parties of the second part or their heirs and assigns 
after the first not has been due twelve months and unpaid to advertise the 
same at the Court House door in the County of Jones and three other public 
places for twenty days and then sell the same at public auction for cash and 
with the proceed thereof to pay the said note or notes with interest abid? 
all necessary costs and charges and the balance if any to pay the said 
parties of the first part in testimony whereof the said parties hereunto set 
their hands and seals the day and year first written.
