DUNN, all of Lenoir Co., NC 9 July 1828 John P. DUNN to Walter DUNN State of North Carolina Lenoir County To Blount COLEMAN and William B. KILPATRICK, Esquires; Greeting: Whereas, John P. DUNN hath produced a deed of conveyance made to him from William LOVICK and Elizabeth his wife, of a certain tract or parcel of land lying and being in the County of Lenoir in the State of North Carolina, and procured the same to be proved by Walter DUNN in the Court of Pleas and Quarter Sessions for the county aforesaid, and it being represented to our said court that Elizabeth the wife of the said William LOVICK is (blank) so that she cannot travel to the court of our said County, to be privily examined as to her free consent in executing the said conveyance. Therefore, we command you or any two of you, that at such certain day and place as you shall think fit, you go to the said Elizabeth if she cannot conveniently come to you, and privily and apart from her husband, examine her the said Elizabeth whether she executed the said conveyance freely and of her own accord, without fear or compulsion of the said William LOVICK her husband. And the examination being distinctly and plainly written on the said deed, or on some paper annexed thereto - and when you shall have so taken the said examination, you are to send the same closed up, under the seals of you or any two of you, together with this writ, unto our said Court of Pleas and Quarter Sessions to be held for the county of Lenoir at the Court-House in Kinston on the first Monday of October next. Witness. D. CASWELL, Clerk of our said Court, at office, the 9th day of July 1828. D. CASWELL, Clk. State of North Carolina Lenoir County July Term 1828 There was the forgoing deed of Sale duly proved in Open Court by the Oath of Walter DUNN who swore that he saw William LOVICK one of the Grantors sign, seal and deliver the same as his act and deed; and was by the Court Ordered to be Registered. At the same time Elizabeth LOVICK the other Grantor being not in Court therefore it is Ordered that Commission issue to Blount COLEMAN and William B. KILPATRICK, Esquires to take the private examination of the said Elizabeth as touching her free will and consent in execution that said deed of sale to John P. DUNN, and return their proceedings to next Court. D. CASWELL, CCC. Enrolled in the Registers Office of Lenoir County 31st October 1828. This Indenture entered into this 21st day of November 1829 between J. P. DUNN of the one part and Walter DUNN of the other part both of the County of Lenoir & State of No. Carolina. Witnesseth that for and in consideration of the sum of Eighteen hundred dollars to the said J. P. DUNN in hand paid by the said Walter DUNN the receipt whereof is hereby fully acknowledged, the said J. P. DUNN has bargained, sold, aliened, confirmed & conveyed & by these presents does bargain, Sell, alien & convey unto the said Walter DUNN his heirs, executors, Administrators and assigns forever a Certain tract or parcel of Land situate lying & being in the County of Lenoir on the North side of Neuse River & on both side of Jericho Branch near the head thereupon being part of three surveys made by Job JONES?, Simon BRIGHT, and Richard CASWELL bounded as follows viz: Beginning at Walter DUNN’S own Corner in Jericho Branch in IVEY’S? line & runs with said Walter’s line N. 70 poles to a small oak, a corner made between said Walter & Will LOVICK, thence with another of said Walter’s lines of his Black land West 34 poles to his corner, thence with another line of his lines - 75 West 360 poles to a Water Oak in a pond, said Walter ’s corner also Henry TULL’S corner, thence with TULL’S line S 25 East 122 poles to a stake TULL’S corner, then with said TULLS next two lines to John WASHINGTON’S line thence with WASHINGTON’S line N 88 poles East 54 poles to a pine & oak near the path WASHINGTON’S corner, thence with another of WASHINGTON’S lines S 27 East 100 poles to where said line crosses a Branch, thence up the sum of courses of said Branch to a Maple near a path a corner made between John WASHINGTON & William LOVICK’S thence with a line of marked trees made between WASHINGTON & LOVICK, N 42 East 120 poles to a stake in the Center of three gums in Jericho Branch a corner also made between said WASHINGTON & LOVICK and thence dow the various corner of Jericho Branch to the Beginning containing by estimation three hundred acres more or less. And all houses buildings orchards profits & appurtenances whatsoever belonging to the same and also all the Estate right title or property claimed by him the said J. P. DUNN in or to the said premises. To have & to hold the lands hereby bargained & sold with their appurtenances, to the only proper use and behoof of him the said Walter DUNN his heirs and assigns forever. And the said J. P. DUNN for him & his heirs Executors, Administrators or assigns does hereby covenant promise and grant to & with the said Walter DUNN, his heirs and assigns, that he is seized of a good sure and indefeasible estate in fee simple of and in the premises aforesaid, and that he has absolute authority to sell & convey the same unto the said Walter DUNN and does hereby warrant and will forever defend the title of the same unto him the said Walter DUNN his heirs execs. Admrs. Or Assigns against the lawful claim or claims of all person’s whatsoever. In witness, whereof I the said J. P. DUNN have hereunto set my hand & made my seal the day & year first above written.
