Lenoir County, NC - Will of Nathan Hill, 1903

In the name of God Amen
     Be it known that I  NATHAN HILL of the County of Lenoir and
State of North Carolina being of sound mind and perfect memory,
thanks be to God, do make and declare this my last will and
testament in manner and form following  That is to say I hereby 
constitute and appoint my friend JESSE HOLLAND my lawful
executor and commend him to execute this my last will and testa-
ment to all intents and purposes as well as I could were I person-
ally present in person.
2nd  It is my will and desire that my executor shall provide for my
body at my death a suitable burial and pay off the expenses of the
same out of any money, credits, or personal property that may then
belong to me the said testator.
3rd  It is my will and desire to lend to my beloved wife AXEY all of
my tract of land situated on both sides of Southwest Creek in 
Lenoir County and State of North Carolina, adjoining the lands of
ORA SMITH, JAMES HILL and others and known as a part of 
THOMAS DAVIS land containing two hundred, 250, acres more 
or less it being the same land on which the testator now resides
with all the appurtenances thereunto belonging to her the said
AXEY HILL to peaceably enjoy as well as I could were I present
in person during her widowhood, or natural life if she never
marries.
4th  It is my will and desire that the above described land at the
expiration of the widowhood of my wife AXEY shall be equally
divided between my two children by my last marriage COOPER
HILL and MARY C. HILL to them to share and share alike in the
above described land and to peaceably enjoy the same with all
the appurtenances as well as I could were I present in person.
5th  It is my will and my desire that my executor shall appoint
three disinterested men to lay off and set apart a liberal allow-
ance for my beloved wife and her two children for one year at
my death.
6th  It is my will and desire that my beloved wife AXEY HILL shall
have at my death the following articles of personal property to wit
one horse and buggy one cart and gear one cow and calf one sow
and pigs one plow and gear one spade one shovel one grubbing
hoe one weeding hoe four rose blankets one bureau two tables
one clock one set of chairs and all of the Kitchen furniture.
7th  I give and bequeath to my beloved son COOPER and daughter
MARY CATHERINE each one bed and furniture and two rose
blket (sic) The remainder of my personal property to be sold for cash
to the highest bidder first giving ___ days notice at the three public
places, the proceeds of sale to be equally divided between my wife
and her children COOPER and MARY CATHERINE after paying my 
just debts if any
8th  It is my will and desire to lend to my beloved daughter NANCY
TAYLOR two tracts of land situated in Lenoir County State of North
Carolina on the south side of South Creek and bounded as follows
(gives description, mentions run of Deep Run, Church lot, John K.
Gray's corner, two tracts contains 126 acres) to NANCY TAYLOR
to peaceably enjoy all her natural life as well as I could were I 
present
in person.
9th  It is my will and desire at the death of my daughter NANCY TAYLOR
that the land that I have given to the said NANCY TAYLOR as above set
fourth shall be equally divided between all the children of the said 
NANCY TAYLOR when the youngest child attains the age of twenty years.
10th  It is my will and desire that in case of the death of either 
COOPER HILL or MARY CATHERINE the surviving one shall inherit both 
shares. But in the case of death of both COOPER HILL and MARY CATHERINE
then their property shall be equally divided between my four oldest 
children JOHN HILL, JONAH HILL, NANCY TAYLOR and JAMES HILL.
11TH  I give and bequeath to my two children COOPER and MARY
CATHERINE all of my tract of land situated south side of Southwest
Creek in Lenoir County and State of North Carolina and known as a 
_____ of the Grady land and bounded as follows ( gives description,
contains one hundred and fifty five acres)
To them the said COOPER HILL and MARY CATHERINE to peaceably
to enjoy as well as I could were personally present in person. But in 
case I sell the land then the proceeds of such sale to be equally 
divid-ed between my two children instead of the land.
     Lastly it is my will and desire that  IRA SMITH, OWEN SMITH and 
A.D. SMITH  shall not have anything whatever to do with my estate.
They defrauded my wife AXEY out of her interest in her fathers estate.
For that reason I desire that they do not interfere with my estate.
     In witness hereof I hereunto set my hand and affix my seal.
