WILL OF THOMAS HARVEY

I, Thomas Harvey, Sen. of the County of Lenoir and State of North 
Carolina, being of sound mind and memory, but considering the 
uncertainty of my earthly existence, do make and publish the following 
to be my last will and Testament in manner and form following, viz:

First.  That my executor (hereinafter named) shall provide for my body 
a decent burial suitable to my circumstances in life, and pay all 
funeral expenses together with all my just debts out of the first 
moneys which may come into his hands as a part or parcel of my estate.

Item 2nd.  I give and bequeath to my youngest son Thomas Harvey two 
hundred and fifty acres of land including the buildings wherein I now 
live and occupy; also two beds and furniture, one side-board, one 
press, one safe, one book-case, one large chest, half dozen chairs, one 
clay bank marc, one cow and calf, ten head of stock Hogs, one bridle 
and saddle, thirty barrels of corn, six hundred pounds of pork, a good 
stack of fodder, one table.

Item 3rd.  I give and bequeath to my son Franklin Harvey two hundred 
and fifty acres of land including the buildings which he now occupies.

Item 4th. All the residue of my lands I leave to be sold and the 
proceeds to be equally divided between the following names:  Amos 
Harvey, Elisa Aldridge, grand-daughter Catherine E. Taylor, also one 
fourth to Matthias Harvey's children.

Item 5th.  I will and devise that my Executor, hereinafter named, shall 
sell all the balance of my property of every name and kind and equally 
divide the proceeds together with all my moneys and notes between the 
following names thus: Amos Harvey one sixth, Matthias' children one 
sixth, Eliza Aldridge, wife of L. H. Aldridge one sixth, Thomas Harvey 
one sixth and grand daughter Catherine E. Taylor one sixth.

And lastly, I do hereby constitute and appoint my son Amos Harvey my 
lawful Executor to all intents and purposes to execute this my last 
will and testament according to the true intent and meaning of the same 
and every part and clause thereof hereby revoking and declaring utterly 
void all other wills and testaments by me heretofore made.

In witness whereof I, the said Thomas Harvey, do hereunto set my hand 
and seal this August 23rd, 1867.

Assigned, sealed published and declared by the said Thomas Harvey to be 
his last will and testament in the presence of us, who, at this request 
and in his presence do subscribe our names as witnesses thereto.

Lenoir County Court January Term, 1868. A paper writing purporting to 
be the last will and testament of Thomas Harvey, deceased, is exhibited 
for probate in open Court by Amos Harvey, the Executor therein named, 
and the due execution thereof by the said Thomas Harvey is proved by 
the oath and examination of Calvin Rouse and Elias F. Albritton, the 
subscribing witnesses thereto. It is therefore considered by the Court 
that the said paper writing and every part thereof is the last will and 
testament of the said Thomas Harvey and the same is ordered to be 
recorded and filed. And thereupon the said Amos Harvey, Executor as 
aforesaid, duly qualifies as such by taking the oath required by law.
