In the Matter of the Will of F.G. DUPREE

J. F. DUPREE being sworn doth say:
That F. G. DUPREE, late of said county is dead, having first made and 
published his last will and testament and that J. F. DUPREE is the 
executor named therein.
Further, that the property of the said F. G. DUPREE consisting of about 
120 acres of land & bed & bed clothing is worth about $600.00, as so 
far as can be ascertained at the date of this application; and that 
Furney DUPREE, Ava A. JACKSON, Jesse F. DUPREE, James E. DUPREE, Wiley 
DUPREE, Evaline JONES, William C. DUPREE, Lula DUPREE, and Elizabeth 
DUPREE are the parties entitled under said will to the said property.

In the Probate Court:
A paper purporting to be the last will and testament of F. G. DUPREE, 
deceased, is exhibited before me, the undersigned Judge of Probate for 
said county, by Jesse F. DUPREE, the executor therein named, and the 
due execution thereof by the said F. G. DUPREE, by the oath and 
examination of David E. CURTIS and Elijah TAYLOR, the subscribing 
witnesses there to who being duly sworn, doth depose and say and each 
for himself deposeth and saith, that he is a subscribing witness, to 
the paper writing now shown him, purporting to be the last will and 
testament of F. G. DUPREE, that the said F. G. DUPRE, in the presence 
of this deponent, subscribed shown as aforesaid and which bears date 
of the 20th day of March, 1877. And the deponent further saith that the 
said F. G. DUPREE, the testator aforesaid, did at the time of subscribing 
his name as aforesaid declare the said paper writing as subscribed by 
him and exhibited to be his last will and testament and this deponent 
did thereupon subscribe his name at the end of said will as an attesting 
witness thereto and at the request and in the presence of said testator. 
And this deponent further saith that at the said time when the said 
testator subscribed his name to the said last will as aforesaid and at 
the time of the deponents subscribing his name as an attesting witness 
thereto as aforesaid the said F. G. DUPREE was of sound mind and memory, 
of full age to execute a will and was not under any restraint, to the 
knowledge information or belief of this deponent. And further these 
deponents say not.

Lenoir County Probate Court, Aug. 8th, 1877
On reading and considering the application of J. F. DUPREE, to admit a 
paper writing, purporting to be the last will and testament of F. G. 
DUPREE, deceased to probate and to be qualified as executor thereof 
according to the appointment there by made and having examined on oath, 
D. D. CURTIS and Elijah TAYLOR, the two subscribing witnesses thereto 
as to the execution thereof. It is adjudged that the said paper writing 
and every part thereof is the last will and testament of the said F. G. 
DUPREE, Dec'd, and the same as such is ordered to be recorded and filed, 
and thereupon the said F. G. DUPREE, the executor aforesaid, comes 
forward, and takes and subscribes the following oath.

I, J. F. DUPREE, do solemnly swear that I believe this writing to be and 
contain the last will and testament of F. G. DUPREE deceased and that I 
will well and truly execute the same by first paying his debts and then 
his legacies, as far as the said estate shall extend, or the law will 
charge me; and that I will well and faithfully execute the office of an 
executor agreeable to the trust and confidence reposed in me, and 
according to law, so help me God.

Whereupon, Letters Testamentary are issued to the said J. F. DUPREE, as 
executor of the said last will and testament.

In the name of God, Amen, Know all men by these presents that I Furney G. 
DUPREE, of the county of Lenoir and state of North Carolina, being now of 
sound mind and memory, but considering the uncertainty of my earthly 
existence do make and declare this my last will and testament, to wit:
First, that my executor herein after named, shall provide for my body a 
decent burial suitable to the wishes of my relation and friends and pay 
all funeral expences out of the moneys that may first come into his hands 
as a part and parcel of my estate.
Item, I give and bequeath to my son Furney DUPREE the house and land that 
he now lives the lines to commence at the ditch bridge near the gate and 
running with the ditch North to the James DAUGHETY'S lines then with the 
old lines to the path near Nathan DAUGHETY'S house, then with the path to 
the beginning.
Item, I give to my daughter Ava A. JACKSON my bead and bead clothing.
Item, I give to my sons Jesse F. DUPREE and James E. DUPREE fifty dollars 
each to balance against horses that I have heretofore given my other sons.
Item, my executor shall shall sell all of my lands together with all other 
property not hereto fore provided for the lands shall be divided into two 
lots commencing at the river and running by the grave yard and running the 
old road out to the Neuse Road at Nathan DAUGETY'S and shall be sold on 
five years time to be paid by five installments with six percent interest. 
The proceeds of my lands and other property not heretofore disposed of 
shall be equally divided between my sons and daughters, namely, Wiley 
DUPREE, Jesse F. DUPREE, Evaline JONES, James E. DUPREE, Ava A. JACKSON, 
William C. DUPREE, Litha DUPREE and Elizabeth DUPREE.
And I do hereby constitute and appoint Jesse F. DUPREE my lawful executor 
to all intents and purposes to executier this my last will and testament 
according to the time intent and meaning of the same, and every part and 
clauses thereof revoking and all other wills and testaments by me 
heretofore made in witness where of I the said Furney G. DUPREE do 
hereunto set my hand and seal this the tweneth day of March A.D. one 
thousand eight hundred and seventy seven.
