W.B. FERREL & wife et al., vs. E. S. BROADWAY
Estate of Jesse W. BROADWAY- Deposition of Alexander HOOTEN
10 Nov. 1883

State of North Carolina
Lenoir County
W. B. FERRELL & wife Georgia C. FERRELL, James L. BROADWAY & others against 
E. S. BROADWAY.
Alexander HOOTEN being duly sworn, says, he is thirty years of age, has 
known Jesse W. BROADWAY and Elizabeth OXLY ever since his recollection up to 
the time of their deaths, has lived in about half mile of them all his life 
except a year or two just previous the death of said J. W. BROADWAY.
This affiant says that the general report in the neighborhood was that said 
J. W. BROADWAY and Elizabeth OXLEY were not married, and that they were 
living together in Fornication and adultery, until a year or so before the 
death of the said Elizabeth, then it was reported by some that they had got 
married but this report was not believed by a great many and the 
neighborhood, he never saw any one that knew that they were married. This 
affiant further says that he don't think more than one child was born to 
them after the report was circulated that they had got married and he is not 
certain that any child was born after that time, He never heard that the 
Plaintiffs claimed to be heirs of J. W. BROADWAY until he heard they had 
commenced this suit, has frequently seen the Plaintiffs and lived in the 
neighborhood with them since the death of the said J. W. BROADWAY.
This Affiant further says that E. S. BROADWAY is a man of sober steady 
habits, is close? in his dealing in money matters, and is in no manner 
extravagant and wasteful. He is acquainted with the home place and it has 
been very much improved in value by the Defendant since the death of his 
father, by buildings, ditching manuring & c.
