Lenoir County, NC - Will of B.W. Britt Sr., 1891

     I, B.W. BRITT SR., of the County of Lenoir, in the State of North
Carolina, being of sound mind and disposing memory, but considering
the uncertainty of this life, do make and declare this to be my last 
will and Testament in manner and form following:
     ITEM 1st  It is my will and desire that my executors provide for 
my body a decent and suitable burial and that he pay my funeral 
expenses together with all my just debts, if any, out of the first 
moneys that shall come into his hands as a part of my estate.
     ITEM 2nd  I give and devise to my sister FRANCIS WHITTED wife of 
W.G. WHITTED of Wayne County, State of North Carolina bounded on 
North by the lands of Joshua Mewborn and Hampton Wade, on the East
by P.F. Suggs land, on the South by lands of Parrott Mewborn and 
Hampton Wade, and on the West by Mark Smith's land. Containing 215
acres more or less, to have and to hold said lands to her and her heirs
forever.
     ITEM 3rd  I give and devise to HATTIE V. TAYLOR, CARRIE TAYLOR, 
NANCY TAYLOR and ADA TAYLOR children of my sister SARAH J. TAYLOR, 
deceased, and their heirs my tract of land situate in Lenoir County, 
State of North Carolina, known as the Buck Branch place, con-taining 90 
acres more or less, same being the tract of land purchased by me from 
C.W. Joyner and wife, reference being made to the deed from said Joyner 
and wife for more particular description. I also give and de-vise to 
the said children of my deceased sister SARAH J. TAYLOR, and their 
heirs thirty five acres of the tract of land on which I now reside, 
known as the Whitfield Place, the said 35 acres of land to be situate 
and lie along and adjoining the said Buck Branch tract and to be cut 
off and distinguished from the remainder of the said Whitfield Tract by 
a straight line to the run from the Atlantic and North Carolina Rail 
Road in the shortest and most direct direction to Moseleys Marsh.
     ITEM 4th  I give to my Mother MRS. NANCY BRITT during her natural 
life the tract of land on which I now live including my dwelling and 
surrounding buildings, said tract being known as the Whitfield tract 
and being situate in Lenoir County, State of North Carolina, save and 
except the 35 acres of said tract devised to the children of SARAH J. 
TAYLOR, deceased, in item 3 above, it being my intention to so give to 
my Mother the remaining portion of said tract containing about one 
hundred acres, and at the death of my said Mother, then I give said 
Whitfield tract containing 100 acres to my sister LULA V. BRITT during 
her natural life, and if my said sister LULA shall die leaving children 
then her said children shall have said tract in fee simple. But 
if my said sister LULA shall die without children then I give and 
devise said tract of land to the children of my said sister FRANCIS 
WHITTED in fee simple. The land devised in this item together with the 
35 acres devised in the 3rd item was deeded to me and OCTAVIUS TAYLOR 
from John W. Sutton & wife and divided between us by the Superior Court 
of Lenoir County, the said 135 acres being allotted to me by the 
commissioners as my share.
     ITEM 5th  I give and bequeath to my Mother MRS. NANCY BRITT during 
her natural life all the personal property of every kind and description 
of which I die possessed or of which I may be entitled to be possessed. 
I do, however, authorize and direct my executor to sell when matured 
and gathered all crops growing on my lands at the time of my death and 
that the proceeds thereof together with all moneys that shall come into 
his hands from notes, bonds and other evidue (?) as of debt belonging 
to my estate, and from any source what-ever shall constitute a fund which 
shall be first liable for and applied to the pay-ment of my just debts 
and liabilities if any; and should said fund and any portion thereof be 
not required in the payment of my indebtedness, then I direct my executor 
to invest the same on good security, and annually to pay over to my said 
Mother the interest accruing thereon for her individual use. All my 
personal property other than that above directed to be sold and invested 
and other than such as may be necessary to be sold to pay my debts and 
funeral expenses in the event the said fund above made primarily liable 
should be insufficient for that purpose, I authorize and direct to be 
delivered over to my said Mother to be used by her during her natural 
life. At the death of my said Mother I give and bequeath, all of my said 
personal property and direct that it all, including any money that may 
have been invested by my executor as above be turned over to my sister 
EMMA V. NEWSOME wife of W.S. NEWSOME to have in her possession and use 
during her natural life, and at her death to her children ab-solutely, 
but if my said sister EMMA shall die without children, then I give and 
be-queath all of my said personal estate to the four children named of 
my deceased sister, SARAH J. TAYLOR, to take into their possession and 
have absolutely.
     ITEM 6th  It is my will and desire and I do direct that my 
executor, before entering report the discharge of his duties hereunder, 
enter into bond in an amount double the value of my personal estate, 
said bond to be as is prescribed by law for executors and 
administrators.
     And lastly I do hereby make, constitute and appoint my trusty 
friend and brother in law OCTAVIUS TAYLOR my executor to all intents 
and purposes to execute this my last Will and Testament according to 
the true intent and meaning of the same and every clause thereof. 
     In testimony whereof I, the said B.W. BRITT SR., have hereunto set 
my hand and seal this the 12 day of May 1891.
