#10,542  STATE AND MARY HARGETT vs JESSE W. BROADWAY

North Carolina Supreme Court Case found at the NC Archives.  The below is from 
the case file but the case from NC Reports is also posted.

Lenoir County, June 1873

On 1 Nov. 1872 the plf, Mary Hargett, received a judgment against the def, 
Jesse W. Broadway, for support of a bastard child  Thomas Harvey and Joshua 
L. Rouse will pay costs  Thomas Harvey stated he was worth $1,000 on 11 Nov. 
1872

Mary (x) Hargett stated sd Jesse Broadway was the father of her child  
Broadway said he was not guilty  the Superior Court jury found sd Broadway 
guilty and he was told to pay $6 for the lying in month and $1 a month after 
until the child is 7 years old  Broadway contested saying he was impotent at 
the time the child was received  Broadway had a son old enough to testify but 
the file does not give his age.

The Supreme Court appears to have found there was an error in the original 
verdict.
