This Indenture, made on the 27th day of November A.D. one thousand eight hundred and
sixty eight between E.F.COX, Sheriff of the county of Lenoir and State of North
Carolina on the one part and Pinckney HARDEE of the county of Lenoir and State of
North Carolina, on the other part, witnessed: That whereas by virtue of Sundry
executions issued from the Superior court of the said county of Lenoir in the name
of Pinckney HARDEE, Edmond R. STANLY and James M. PARROTT; that is to say; one
Execution in favor of Pinckney HARDEE for Seven Thousand six hundred and one 25/100
dollars, interest on seven thousand five hundred dollars from 16th March 1868, and
Eleven 60/100 dollars cost; one execution in favor of E. R. STANLY for Six thousand
and thirty one 56/100 dollars, interest on five thousand eight hundred and forty
five dollars, from 14th March 1868, and twelve 60/100 dollars cost; one execution in
favor of James M. PARROTT for six hundred and fifty four 38/100 dollars interest one
six hundred and thirty nine 34/100 dollars from 16th March 1868, and ten 60/100
dollars cost; one other Execution in favor of the same for thirteen hundred and
Eleven 27/100 dollars, interest on thirteen hundred dollars from 16th March 1868,
and ten 60/100 dollars cost; and one other Execution in favor of the same for three
thousand three hundred and eighty five 50/100 dollars interest on three thousand
dollars from the 16th March 1868 and ten 60/100 dollars cost-which sum was recovered
by the said Partners against John A. PARROTT in said court, as on record may appear;
and whereas the said execution was directed and delivered to the said E. F. COX,
high Sheriff as aforesaid commanding him that of the Goods and Chattels, Lands and
Tenements of the said John A. PARROTT, he should cause to be made the aforesaid sum
of Eighteen Thousand nine hundred & eighty three 46/100 dollars, to satisfy the said
execution with the costs thereon, and the said E. F. COS, Sheriff as aforesaid, in
pursuance and by virtue of his office, and the aforesaid execution did seize and
take into his hands and custody (no goods and chattels to be found) a certain piece
or parcel of land, situate, laying and being in said county of Lenoir on the So.
Side of the River bounded as follows: and on the north side of South West Creek,
beginning at a pine stump in the edge of the old field, and runs south 80 East 72
poles to a red oak down these north 45 east 46 poles, then south 55 east 68 poles,
then north 107 poles, then north 85 west 173 poles, then South 2 West 83 poles to
the beginning containing 97 1/2 acres more or less; being known as apart of the
Kenton TAYLOR land, in the division of the lands of Jesse JONES, dec’d. Also one
other tract or parcel of land adjoining the above, beginning at a stake and runs
north 86 East 26 poles to a red oak, on South west Creek, then north 24 West 62
poles to a pine, then north 57 poles to a post oak, then north 23 west 16 poles to a
stake, then So. 84 West 164 poles to a stake, then South 2 West 94 poles to a stake,
then also one other tract of land known as the HOOD place, on the South side of the
River, beginning at an Ash on SandyCreek, and runs South 75 East 51 poles to a stake
on the north side of a Grove yard, then South 82 East 78 poles to a small Walnut
tree south of the Fred JONES house, then north 89 East 62 1/4 poles to the South
side of the gate post, where the gate now stands leading out to the avenue, then
South 80 East 84 poles then South? 50 East 83 poles to a corner on the South side of
the main road leading to Kinston, the corner made by Michael TILGHMAN to Elizabeth
and Nancy TILGHMAN, then north 46 West 413 3/4 poles to Neuse River, then up the
various corner of the River tot he mouth of Sandy Creek, then up the Creek its
various corner tot the beginning, containing 199 acres and 36 poles, more or less -
And the said E. F. COX, Sheriff as aforesaid after due advertisement according to
law, did cause the said piece or parcel of land with all the appurtenances thereof
belonging, to be put up at public sale, to the highness bidder, on the third day of
October A.D, one thousand eight hundred and Sixty eight in the town of Kinston,
N.C.; at which time and place aforesaid Pinckney HARDEE became the last and highest
bidder, at the sum of seven hundred dollars, for the said lands, with the
appurtenances thereunto belonging; This Indenture, therefore, Witnesseth, that he
said E. F. COX, Sheriff of Lenoir County as aforesaid, for and in consideration of
the sum of Seven hundred dollars, to him in hand paid by the said Pinckney HARDEE at
and before the selling and delivery of these presents, the receipt whereof is hereby
acknowledged, he the said E. F. COX, sheriff, doth hereby bargain, sell, alien,
enfeoff, convey and confirm unto the said Pinckney HARDEE his heirs and assigns
forever, all the right, title, claim, interest or demand of him the said John A.
PARROTT, tin the aforesaid piece of parcel of land, with all the hereditaments and
emoluments to the same belonging or in anywise appertaining; to have and to hold to
him the said Pinckney HARDEE his heirs and assigns, in as full and ample manner as
he, the sheriff is empowered by virtue of his office to convey and assure the same:
And further, the said E. F. COX, sheriff doth hereby covenant, promise and grant to
and with said Pinckney HARDEE, his heirs, executors, administrators and assigns,
that he the said Pinckney HARDEE his heirs and assigns, shall and may from time to
time, and at all times hereafter, have, hold, occupy, possess and enjoy the said
hires and assigns, shall and may from time to time, and at all times hereafter, have
hold, occupy, possess and enjoy the said premises with the appurtenances, free and
clear of and from all encumbrances had, made, done or committed by him, the said
sheriff, or his order, means or procurement; and the said E. F. COX, sheriff, will
warrant and defend the same to the said Pinckney HARDEE his heirs and assigns,
forever, so far as his office of sheriff will admit, and no further.
In testimony whereof, the said E. F. COX, sheriff of Lenoir county, hath hereunto
set his hand and seal, the day and year first above written,

The execution of the foregoing deed from E. F. COX, Sheriff to Pinckney HARDEE, ws
this 30th day of November, 1868, proved do before the undersigned Judge of Probate
for said county by the oath of WM. W. N. HUNTER, the subscribing witness thereto.
Therefore, let the said deed together with this certificate, be registered.
