PEBBLES, adm’r to Jno. C. WOOTEN, agst. Michael TILGHMAN, Michael SHELFER & Jesse HOLLAND. Sept. 1869. State of North Carolina To the Sheriff of Lenoir County - Greeting. Whereas an action of Debt was lately pending in our Superior Court of the County of Lenoir in the name of H. E. A. PEEBLES, Admr. To use of John C. WOOTEN , Admr. Against Michael TILGHMAN, Michael SHELFER and Jesse HOLLAND, in which the said H. E. A. PEEBLES, Admr. To use of John C. WOOTEN, adm’r Saught to recover against the said Michael TILGHMAN, Michael SHELFER and Jesse HOLLAND the sum of One Hundred & Seventy Six Dollars and the said Michael TILGHMAN one of the defendants died after the commencement of the Said Suit and died Intestate during its pendency and after whose death administration upon his Estate was duly granted to John A. PARROTT as we have been informed and whereas at the Sept. A.D. 1869 of said court the death of said Mike TILGHMAN was suggested on the record and it was therefore ordered that a Sci Fa should be issued against the said John A. PARROTT, adm’r as aforesaid according to an Act of the Assembly, these are therefore to command you that you make known to the said John A. PARROTT, admr as aforesaid that he appear before us at our said court to be held for the county of Lenoir at the court house in Kinston on the 7th Monday after the 4th Monday in Sept. A.D. 1869, then and there to defend the said Suit to do and receive what our Said court shall consider of him in this behalf, and have you then and there this writ with your due returned thereupon.
