Hiatt and Elizabeth [Scott] Hiatt, and Thomas Scott, 1880.

This Deed made this 25 day of February in the year one thousand eight hundred 
and eighty between JESSE E. HIATT and ELIZABETH HIATT, his wife, and THOMAS 
SCOTT of the first part, and CATHERINE HARROLD and ENOS S. HARROLD of the 
second part: Witnesseth that in consideration of the sum of sixty dollars 
paid in a land swap, the said JESSE E. HIATT and ELIZABETH HIATT, his wife, 
and THOMAS SCOTT, doth grant unto the said CATHERINE HARROLD during her 
natural life and then to ENOS SYLVESTER HARROLD and his heirs forever with 
general warrantry all of a certain piece or parcel of land lying or being in 
the County of Carroll and Patrick on both sides of the Ward's Gap Road and on 
the waters of Johnson's Creek. Beginning at the fork of the Ward's Gap and 
Volunteer Roads, thence with REYNOLDS MCMILLIAN'S line N69 W53 poles crossing 
branch to sourwood and pointers in EMELINE HIATT'S line with said line S23 
W68 poles to a maple on a high ridge S68 W35 poles to a white oak in the 
HIATT and CHAPPELL line, S33 E32 poles to a white oak (not found) S13 W20 
poles to a stake at the turn of a fence S67 1/2 poles to a stake in a line 
called Seiwers line with said line N42 E13 poles to a corner chestnut in the 
(so called) WAUHOP line with said line. N83 E56 poles crossing a branch to a 
Spanish Oak on the Ward's Gap or county line Road, thence with said road N27 
W10 poles, N39 W22 poles to two chestnuts on the east side of said road at 
the corner of a fence, thence N49 E57 !/2 poles crossing the branch to a 
poplar near the same (now dead) N21 1/2 W72 poles to a white oak on the 
Volunteer Road in R. MCMILLIAN'S line S47 W24 1/2 poles to the beginning 
containing eighty two acres be the same more or less, the said THOMAS SCOTT 
only joins in this deed for the purpose of satisfying the act of his father 
JOHN SCOTT, who conveyed the above described land to ELIZABETH HIATT, the 
land lying in Patrick County amounting to 17 acres, being patented to the 
said THOMAS SCOTT and he never conveyed the legal title to JOHN SCOTT, but 
now conveys the same with special warranty to both CATHERINE and E. S. 
HARROLD as above. The said JESSE E. HIATT and ELIZABETH HIATT covenant that 
they have the right to convey the said land to the grantees; that they have 
done no act to encumber the said land; that the grantees shall have quiet 
possession of the said land free from all encumbrances and that JESSE E. 
HIATT, ELIZABETH and THOMAS SCOTT parties of the first part will execute such 
further assurance of the said land as may be requisite.

State of Virginia, County of Patrick, to wit:
I, Robert M. Clark, a Notary Public for the County aforesaid in the State of 
Virginia, do certify that JESSE E. HIATT and THOMAS SCOTT whose names are 
assigned to the within writing, bearing date on the twenty fifth day of 
February 1880, have acknowledged the same before me in my County aforesaid. 
Given under my hand this 25th day of February 1880.

State of Virginia, County of Patrick, to wit:

I, Robert M. Clark a Notary Public for the County of Patrick in the State of 
Virginia, do certify that ELIZABETH HIATT, the wife of JESSE HIATT, whose 
names are signed to the within writing, bearing date on the twenty fifth day 
of February 1880, personally appeared before me in the county aforesaid and 
being examined by me privately apart from her husband and having the writing 
aforesaid fully explained to her, she the said ELIZABETH HIATT acknowledged 
the said writing to be her act, and declared that she had willingly executed 
the same and does not wish to retract it. Given under my hand this twenty 
fifth day of February 1880.

Note 1: Elizabeth Hiatt, wife of Jesse Hiatt herein, is Elizabeth [Scott] 
Hiatt, daughter of John Scott and Affirah Ayers.

Note 2: Thomas Scott, named herein, is the son of John Scott and Affirah 
Ayers, and husband of Matilda [Hiatt] Scott. 

Note 3: John Scott is the husband of Affirah Ayers, and son of Thomas and 
Catherine Scott.

Note 4: Reynolds McMillian, son of Nathaniel and Anna McMillian, is the 
husband of Lydia [Scott] McMillian, daughter of John Scott and Affirah Ayers.

Note 5: Enos S. Harrold is Enos Sylvester Harrold, son of Elijah Harrold and 
Catherine Scott.

Note 6: Catherine [Scott] Harrold, grantee, is the daughter of John Scott and 
Affirah Ayers, and the widow of Elijah Harrold.

Note 7: Emeline [Scott] Hiatt is the daughter of John Scott and Affirah 
Ayers, and the wife of Enos Hiatt.
