This Indenture made this 27th day of September 1828 between John Gilbert of 
the County of Patrick and State of Virginia of the one part and Saml. Sharp 
of the same County and State of the other part Witnesseth that for and in 
consideration of the sum of one dollar in hand paid the receipt of which is 
hereby acknowledged by the said John Gilbert and more especially in 
consideration of a debt due from the said John Gilbert to Abram Staples of 
the third part of fifty six pounds one shilling and three pence by bond 
bearing date even with this indenture as will more fully appear reference 
being had thereto. The said John Gilbert hath this day granted, bargained 
and sold unto the said Saml. Sharp trustee his heirs and assigns the 
following land and property Viz. one certain tract or parcel of land situate 
lying and being in the County of Patrick on the waters of the South Mayo 
river and supposed to contain one hundred and five acres be the same more or 
less , beginning at a poplar on a branch thence running west to said 
Sheltons line thence with said Sheltons line a Southwardly course to Leeks 
line thence with said Leeks line Eastwardly crossing a small branch to the 
branch just mentioned thence up said branch as it measures to the beginning 
it being the tract on which the Gilbert at present resides and purchased 
from E Shelton decd.  Also the following property to wit, three head of 
horses to wit, one old bay mare supposed to be seventeen years old, one 
sorrell mare four years old, one grey mare three years old, with their 
entire future increase fifteen head of cattle of various sizes and ages and 
marked with a cross in the right & a slit in the left ear, fourteen head of 
sheep marked the same way twenty five head of hogs of various sizes and ages 
same mark with the future increase of cattle sheep and hogs four beds and 
furniture the whole of the household and kitchen furniture of various 
descriptions too tedious to enumerate 4 hoes 3 axes together with the whole 
of his tools and plantation utensils.  To have and to hold the aforesaid 
Land and property with all and singular its appurtenances thereunto 
belonging or in any wise appertaining to him the said Saml. Sharp Trusteee 
as aforesaid and his heirs and assigns forever against the claim or demands 
of all and every person or persons claiming under him the said John Gilbert 
either in law or equity Upon this trust and confidence that if the said debt 
due as aforesaid to A. Staples shall remain unpaid on the 1st of November 
next then the said Saml Sharp shall when ever required by the said A. 
Staples or his heirs or assigns upon giving ten days publick notice at 
Patrick courthouse of the times and place of sale proceed to sell the 
aforesaid land and property to the highest bidder for actual cash for the 
best price that can be got and out of the proceeds thereof first pay the 
said Staples his debt with Interest and all the costs attending the making 
and execution of this Indenture and the surplus if any pay the said Gilbert 
or assigns and the said Gilbert pledges himself to guarantee the purchaser 
or purchasers as the case may be a good and lawful general warranty deed of 
conveyance But should the said debt be paid up by the time aforesaid to the 
said Staples or his heirs or assigns with cost and Interest & then and in 
that case this Indenture is to have no effect and to be null and void else 
to remain in full force and virtue.

their hands and affixed their seals the day and year first above written.

This Deed of Trust from John Gilbert and Samuel Sharp trustee to Abram 
Staples with the certificate thereon endorsed, was exhibited in Court, 
examined and ordered to be recorded.
