Sale of land lying in both Cecil Township, Washington Co and South
Fayette Township in Allegheny Co PA.  Recorded in Allegheny Co Deed
Book 5-E, pgs. 330 thru 332.

This indenture made the first day of September in the year of Our Lord
one thousand seven hundred and ninety six Between Presley Nevill of the
Borough of Pittsburgh and State of Pennsylvania Attorney infact for
Robert Rutherford Esquire of the County of Berkley and State of
Virginia by power of Attorney to him the said Presley by him the said
Robert given bearing date the eight day of May in the year of Our Lord
one thousand seven hundred and eighty eight of the one part and Thomas
Swearingen of the County of Washington and State of Pennsylvania of
the other part.  Whereas the said Robert Rutherford in the year of Our
Lord one thousand seven hundred and seventy nine and on the twenty
third day of December in said year obtained a patent from the
Commonwealth of Virginia under the hand and seal of Thoms. Jefferson
Esquire Governer thereof calling for nine hundred acres of Land
situate on coal run a branch of Charters Creeck their in Yohogania
County but now is part in Washington part in Allegheny Counties in the
State of Pennsylvania, also the said Robert after the aforesaid Land
fell into the State of Pennsylvania obtained another patent from the
State of Pennsylvania calling for sixty four acres and three eights
adjoining the aforesaid tract of nine hundred acres on the East side
theirof under the hand and seal of Benjamin Franklin Esquire President
of the Supreme Executive Council of the Commonwealth of Pennsylvania
bearing date the twenty fourth day of May one thousand seven hundred
and eighty seven.  Now This Indenture Witness that the said Robert
Rutherford by said Presley Nevill his Attorney for and in consideration
of the sum of two thousand two hundred and sixty two Dollars Lawful
Money of the United States of America to him the said Robert in hand
well and truly paid by the said Thomas Swearingen at and before the
sealing and delivery of these presents the receipt whereof he the said
Robert by the said Presley his Attorney doth hereby acknowledge hath
granted bargained sold released infeoffed(?) and confirmed and by
these presents doth grant bargain sell release enfeoff(?) and confirm
unto the said Thomas Swearingen and to his heirs and assigns forever
all the right title interest property and claims of him the said
Robert both at Law and equity of in and to apart of one and the whole
of the other of the two before described tracts of Land beginning at a
Hickory corner to Wilson thence North eig--- seven Degrees East one
hundred perches to a post in John Faucetts field thence with said
Faucetts Line North fifty seven degrees East two hundred and ninety
four perches to three White Oaks thence North three and a half degrees
West one hundred and seventy four perches to two White Oaks thence
North sixty two degrees West twenty eight perches to a post thence by
Lands of Adam Hickman North thirty seven degrees West one hundred and
twenty one perches to a White Oak thence North eighty three degrees
West sixty eight perches to a Hickory thence South twenty one degrees
West one hundred and five perches to a White Oak thence South eighty
eight degrees West two hundred and ten perches by Land of William
Cochran to three white oak thence South two and a half degrees East
one hundred and fifty two perches to two Black Oaks thence North
eighty eight degrees East sixty two poles to a Black Oak thence South
three degrees East two hundred and ten poles to the place of beginning
containing seven hundred and eighty acres and one half of Land be the
same more or less Together with all and singular the hereditaments and
appurtenances to the same belonging or in anywise appertaining To have
and To hold the above described tract of Land and premises with the
appurtenances unto the said Thomas Swearingen his heirs and assigns
forever under and subject to the payment of any Moneys rents or Duties
that hereafter may accrue in the same and the said Robert Rutherford
by the said Presley Nevill his Attorney for himself his heirs executors
& administrators doth hereby convenant promise and grant to and with
the said Thomas Swearingen his heirs executors administrators and
assigns that he the said Robert and his heirs the aforesaid tract or
piece of Land containing seven hundred and eighty acres and one half
against him and his heirs and against all and every other person or
persons Lawfully claiming the same shall and will Warrent and forever
defend by these presents In Witness Whereof the aforesaid Presley
Nevill Attorney for the said Robert hath hereunto set his hand and
seal the day and year first within written.

Allegheny County To Wit  On the first day of September in the year of
Our Lord one thousand seven hundred and ninety six came before me the
subscriber one of the associate Judges of the Court of Common Pleas
of the County aforesaid Presley Nevill Attorney infact, for the within
mentioned Robert Rutherford and acknowledged the same to be his act
and deed for the use in the aforesaid writing mentioned.
