#2480  STATE vs LOFTIN

NC Supreme Court Case found at the NC Archives

Superior Court of Lenoir Co  Fall Term 1836

Jurors  Pinkney Hardee, Oliver Herring, James Davis, Richard Prescott, Aretas 
Jones, John Williams, Thomas Hill, Winsor Dixon, Arthur Cunningham, William 
Gray, James Jones, Oxley Johnson, Jesse Lassiter, Shadrack E. Loftin, Samuel 
Howard, Needham Hollamon, Guilford Murphey, Reuben Clark  

Bill of indictment  William C. Loftin on 1 March 1836 was a Justice of the 
Peace and knowingly broke the law by celebrating the rites of matrimony 
between Frederick Letchworth and Betsy Humbles without license  by doing so 
he deprived the sd Letchworth of his good name, fame, credit  he conspired to 
get the sd Letchworth intoxicated in order to perform the marriage.

It appears the local court found him guilty on one count but not on the other 
and it went to the Supreme Court where they found the Superior Court made the 
correct judgment - the state requires a marriage license with the exception of 
the Quakers but there may not have been a violation in this case  appears to 
refer it back to the Superior Court.
