#191  HOUTON vs HOLLIDAY

North Carolina Supreme Court Case found at the NC Archives.  The below is from 
the case file but the case from NC Reports is also posted.

Caleb Houten vs William Holliday
April Term 1808 Lenoir County

Henry Taylor by his Will dated 21 Nov. 1797 bequeathed to his daughter Lucy a 
Negro man Harry. In 1800 sd Taylor borrowed 100 pds from the def William 
Holliday and secured the debt by the following Deed

I Henry Taylor of Greene Co for $200 by William Holliday of Greene Co a Negro 
man Harry  condition if debt is paid by 25 December next then this deed is 
null and void

NOTE: There was not a copy of the actual deed in the file and no date.

Sd Taylor died April 1800 and the Will was proved with Micajah Edwards as 
Exec  Caleb Houten the plf intermarried with Lucy Taylor in April 1801 and 
the Exec gave the Negro to the plf  the Negro remained in the possession of 
the def from March 1800 to April 1803 and is worth 30 pds per year.  In April 
1803 the plf paid Holliday the $200 pledged and the Negro was delivered to 
him  plf demands satisfaction of the service of the Negro which def refuses 
to make  the plf wants the money for the time sd Negro was in possession of 
sd Holliday

The Court found in favor of the plf for 48 pds
