Lenoir County, NC - John Garland, Guardian of Thomas P. Bruton, 1850

NOTE: John C.M. Garland's father, Kinchen, is on the 1790 census in Greene 
co. Also on voters lists in 1794 I believe. On the tax list in 1816. They 
left NC abt. 1818, John C.M was born in 1819 in Madison County. Kinchen 
settled on the Forked Deer river in the southern part of Madison co. John 
C.M. ran a mercantile store in the Mt. Pinson community as early as 1840.

Thomas Pinckney Bruton is a proven son of Joseph Bruton of Lenoir County. 
The connection between the two families is not proven at this point, but 
both moved to Madison County, Tenn.

    John C.M.Garland was this day appointed Guardian for Simon, Addison, 
William H. and Mary Ann Bruton minor orphans of Thomas P. Bruton deceased 
who thereupon came into court and entered into and acknowledged his bond 
in the penal sum of two thousand dollars with John B. Love and J.D. McClellan 
his securities who thereupon came into court and acknowledged said bond to be 
their act and deed for the purposes therein contained. (end)

    Be it remembered that on this 16th day of July 1851 came on this cause 
to be further heard by the Honl. Calvin Jones, Chancellor &C upon the report 
of the C and Master as to the title and it appearing to the satisfaction of 
the court that the title to the lands purchased by the guardian for his wards 
as well as that sold by him to Geo A. Connally formally belonging to said 
wards which will be hereafter more fully described is good. The repore is 
therefore in all things confirmed. 
    It is therefore ordered adjudged and decreed by the court that the title 
in and to the following described lying and being in the county of Madison 
state of Tennessee and bounded as follows:

Beginning at a stake & Post oak & red oak pointers the N.E. corner of Res Entry 
No 2847 in the name of William Patterson - Runs East 58 poles to a stake with 
black oak and hickory pointers, the S.E. corner of Entry No _ Thence North 86 
poles to a post oak with hickory pointers, Thence East 150 poles to a white oak, 
Thence South 154 poles to a stake, Thence East 43 Poles to a post oak  in the 
west boundary line of occupant Entry No. 2480 made in the name of Thomas L. 
Garland (p. 221) Thence south with said line 133 8/10 poles to a post oak with 
post oak pointers, Thence West 251 poles to a post oak and Spanish oak pointers 
in the north line of Entry 987 for 1000 acres and the S.E. corner of Res Entry 
No 2847. Thence North 198 poles to the beginning, containing 400 acres be 
divested out of Martha Bruton widow of Thomas P. Bruton, Martha, Simon, Addison, 
John, William H. and Mary Ann Bruton, minors and heirs of said Thomas P. Bruton, 
their heirs and assigns forever and be vested in Geo. A. Connally his heirs and 
assigns forever, and that the title in and to the following described land lying 
and being in the county of Madison state of Tennessee bounded as follows, 
Beginning at a dead walnut 79 poles west of the S.E. Corner of Entry No 9 and 
runs west 54 poles to a stake, Thence North 5, East 217 1/2 poles to a chestnut, 
Thence North 233 poles to a stake, dogwood and two beech pointers, Thence East 
29 poles to a stake L. Greens corner Thence South 83 poles to a Beech a corner 
of the same, Thence East 84 poles to two beeches in west line of Entry No. 68 
for 640 acres, Thence South 268 poles to a beech and holly, Thence west 79 poles 
to a large red oak Thence South 100 poles to the beginning containing 238 acres, 
be divested out of Geo A. Connally his heirs and assigns forever, and be vested 
in Martha, Simon, Addison, John, William H. and Mary Ann Bruton, minor heirs of 
said Thomas P. Bruton their heirs and assign forever as tenants in common and 
that said Martha Bruton widow of said  deceased be vested with the same interest 
that she had under the will in the 400 acre tract No grant 3788 which has been 
exchanged by said guardian for the last described land of 238 acres and that the 
said guardian pay the costs of this proceeding out of the Estate of said wards.

Upon motion and it appearing to the satisfaction of this court administration 
of all and singular the goods and chattels right and credits of Joshua Tucker 
deceased was this day granted to John C.M. Garland who thereupon came into 
court and qualified according to the law and entered into and acknowledged his 
bond in the the penal sum of five thousand dollars with Jesse P. Bruton and 
John B. Love his securities. 

It is therefore ordered by the court that letters of administration issue.
