#2542  METTS vs BRIGHT and WILCOX  1838

NC Supreme Court cases found at the NC Archives

Lenoir Co  Superior Court March Term 1838  James E. Metts vs Mortimer Bight 
and Watson Wilcox  Trespass  case agreed

John Stephens was indebted to the firm of  J. & J.  C. Washington and secured 
by a deed of trust dated __ day of ___ to James E. Metts as trustee  property 
left in the possession of sd Stephens  deed proven before Lewis C. Desmond, 
Clerk, and registered the same day at 7:00 pm  on the same day at 9:00 pm the 
firm of Wilcox and White of which def Wilcox was a partner obtained judgment 
before a JP against sd Stephens and by direction of sd Wilcox and levied by 
def Bright on the property  the deed did not give the day it was recorded  
just the time

Another statement indicates the year of the deed was 1837  some question as 
to whether the court was justified in issuing the judgment  

Indenture  7 Oct 1837  John Stephens of the first part, James E. Metts of 
the 2nd part and J. and J. C. Washington by J. C. Washington the surviving 
partner  sd Stephens indebted to sd J. and J. C. Washington for $820.08 on 
several notes  some payable to the Washingtons, two payable to Edmond B. 
Bettemy dated 8 Aug 1831  secured by personal property and crops
