Mortgage Deed
31 Jan. 1880

State of North Carolina
Lenoir County
This Deed made this 31st day of Jany. 1880 between Uzza MILLS and of Onslow 
county of the first part and J. H. BELL of Lenoir of the second part.
Witnesseth:
That for and in consideration of one dollar the receipt of which is hereby 
acknowledged, the part of the first part has bargained and sold, and hereby 
convey unto the party of the second part all that parcel or tract of land 
situated in Institute Township in the County aforesaid adjoining the lands of M. 
B. CREECH, Jno. B. WHITE and others, and bounded as follows, Beginning, 
Beginning at a stake at the Duck Pond & runs with M. B. CREECH'S line S 49 W 64 
poles to a stake then a straight line to said M. B. CREECH'S line to the road to 
a red oak, then with CREECH'S line to the run of Wheat Swamp, the ups Wheat 
Swamp to Thomas HODGES crossway & to the Gum trees, a corner made by DUNN & 
CREECH beginning, containing 110 acres more or less.
To Have and to Hold the said parcel of land together with all the privileges and 
appurtenances thereunto belonging unto the party of the second part his heirs 
and assigns forever. Upon the following uses and trust namely: Whereas the party 
of the first part is indebted to the party of the second part, on account of 
purchase money in the sum of Eight Hundred Dollars, payable on the 1st day of 
May 1885 and balance payable Jany. 1st 1886 with interest thereon from date till 
paid at the rate of eight per centum? per annum, and should not any instatement 
of interest be paid as it accrues such instatement shall thereafter bear 
interest till paid, at the rate aforesaid: Now therefore, if the party of the 
first part shall pay the said debt, both principal an interest as the same 
becomes due and in other respects, comply with the provisions of this deed, then 
this deed shall be null and void; but if the party of the first part shall fail 
to pay the said principal money, when it becomes payable or any instatement of 
interest thereon as it accrues, then the party of the second part shall be at 
liberty to sell the said tract, or parcel of land for cash at the Courthouse 
door in the Town of Kinston after making public advertisement for twenty days in 
some newspaper published in said County of Lenoir and after paying the expense 
of making such, sale, including per centrum on the amount of the sale, apply the 
proceeds of sale to the payment of so much of said debt as may there remain 
unpaid. The premises may be sold in mass or in lots as the party of the second 
part may deem best: and the expenses of dividing the same into lots, and of 
making gall necessary surveys and plus shall be paid out of the proceeds of 
sale.
It is further agreed that the party of the first part shall remain in possession 
of the premises so long as he may comply with the provisions of this deed and 
pay all tax which from time to time be assessed upon said premises. And the said 
Uzza MILLS -- and agree with the party of the second part, that at the time of 
executing this deed he is seized of a fee simple title in the premises hereby 
conveyed; that the same are free from any and all encumbrances whatever; and 
that he will forever warrant and defend the said title, and the quiet possession 
of said premises, unto the party of the second party his heirs and assigns.
In testimony where the said Uzza MILLS has hereunto set his hand and seal this 
day and year first above written.

The execution of the forgoing Instrument was this day proved before me by the 
oath and examination of J. W. TILGHMAN the subscribing witness thereto set the 
same with this certificate, be registered.
