                    WILL OF JOSEPH DEFFENBAUGH

In the name of God Amen, I Joseph Deffenbaugh of German Township,
Fayette County and State of Pennsylvania being of sound mind and
memory, do make and constitute this my last Will and testament in
manner and form following viz.  After all my just debts and funeral
expenses the all be fully paid, I do will and bequeath to my son
Albert W. Deffenbaugh, the sum of two hundred dollars in cash, also
the brown mare colt, saddle and bridle also one bed and bedding to
have his choice in the beds.  And further I will and bequeath unto my
son Albert W. Deffenbaugh the right of living on the farm and making
off of it what he can until he can obtain the proceeds of his labor
in a spring crop to have and to enjoy all the proceeds of the farm
and house until the first of December next.  And further I do
bequeath to my daughter Hannah? Maria Deffenbaugh the sum of fifty
dollars, I bequeath to Mary E. Funk the sum of fifty dollars.  I
bequeath to my niece Martha Jane ______ the sum of one hundred
dollars in addition to what she has already received.  After the
above bequests and my funeral expenses and just debts are paid my
will and desire is that the remainder of my estate be equally divided
between the following named children.  Mary E. Funk, Sarah Woodward,
Martha Riffle, Elizabeth Woodward and Albert W. Deffenbaugh to share
and share alike.  My will is that as soon as my son Albert's lease of
the farm terminates in December next, my farm and stock remaining be
sold and the proceeds divided as herein mentioned.  I do hereby
appoint and ordain as Executor of my last Will and testaments my
son-in-law John Funk and my son Albert W. Deffenbaugh whom I do fully
authorize and empower to carry out all the provisions of this will
according to law and to my know makes and I further authorize my
Executors to sell, at any time such stock or other personal property
as my son may think unnecessary on the farm during his lease the
proceeds to be applied to paying taxes and other debts, my son to
reserve enough in his hands for all necessary purposes during his
lease.

Sworn under my hand and seal this 9th day of May Anno Domini, one
thousand eight hundred and sixty-seven.

               Be it remembered that on the 22nd day of April A.D.
1868 before me Geo Morrison Register for the Probate of Wills and
granting Letters of Administration and for said County personally
came William P. Green and Geo W. Green subscribing witnesses to the
foregoing instrument of writing purporting to be the last Will and
testament of Jos. Deffenbaugh dec'd who being duly affirmed, say that
they were personally present and saw the testator sign and seal and 
heard him declare the same as and for his last Will and testament
when of sound and disposing mind memory and understanding that they
signed as witnesses thereto by the request of the testator in his
presence and in the presence of each other that they know of no undue
influence used or later will made.





     In testimony whereof I have hereunto set my hand and seal of
said office the day and year first above written

Letters testamentary granted to John funk and Albert W. Deffenbaugh
April 22nd 1868.
