Contributor's Note: Joseph is the son of Daniel & Ruth Boothe of Caroline 
Co., VA. Daniel Sr., died in 1849 in Caroline Co., VA. By 1850 Ruth 
married James Trice. John W. Boothe is made guardian of his brother Joseph 
Booth and sister Gilly Booth in Orange Co., NC, Aug. 1763. Joseph was age 
14 and Gilly age 16. Since we have found Daniel and Priscilla Boothe's son 
Joseph M. Boothe living in Amite Co., MS with his sisters Sylvia(Dixon), 
Sarah(Dixon) & Henrietta (Ritty)(Dixon), this clears up the confusion of 
the Daniel & Joseph relationship. Joseph Boothe who resided in Orange Co., 
NC and who married Sarah Barbee is Daniel's brother not his son!

Will of JOSEPH BOOTHE (Son of Daniel & Ruth Boothe)

In the name of God Amen September the 1st day one thousand eight hundred 
and twenty four
I, Joseph Boothe Senr of Orange County and State of North Carolina 
considering
the uncertainty of this mortal life though being weak in body yet of 
perfect mind and memory for this thanks be to mighty God for the same do 
make and publish this my last will and testament in manner and form 
following that is to say I will all my land & Plantation where I now live 
unto my beloved wife Sarah Boothe but desire my son Joseph Boothe the 
liberty of living the same as he has been accustomed to do.

Item, I give to my beloved wife my stock of every description also my 
household and my kitchen furniture

Item, I give to my wife Sarah during her lifetime fourteen negros namely 
Daniel, Harry,Fillas, Nan, Black Beck, Tom, Oliver, Celia, John, James, 
Yellow Beck & Brister, Bartlet & Edmund. I give unto my granddaughter 
namely Mary Herndon daughter of Lewis Herndon one Negro girl named Rachel.

Item, I give unto my daughter Mary Herndon one negro girl named Ferriba.

Item, I give unto my grandchildren namely Joseph B. Herndon, George 
Herndon, Lewis W., Mary Herndon all their mothers part of my estate to be 
equally divided between them with the exception of the above named Rachel. 
Item, I give unto my daughter Rosy Reach one negro boy named Hembro. Item, 
I lend unto Rosy Reach during her lifetime my negro girl named Brise, 
after her death Brise is to belong to her daughter Mary Yates, I give to 
my daughter Elizabeth Stone my two negros name Sam and Mary.

Item, I give unto my daughter Emilia George two negros namely Sylva & 
Handy.

Item, I give to my daughter Tabitha Herndon my two negros namely Tom and 
Hinsken.

Item, I give to my daughter Delilah Yates my two negros Pat and Isiah.

Item, I give to my daughter Sally George my two negros Ed and Peter. I 
give also to Sally a walnut bureau after my wife's death.

Item, I give to my son Joseph Booth after the death of myself and my wife 
my land and plantation in which I now live, I also give him one dollar & 
my carpenter tools & mill, after the death of myself & my wife Sarah.

Item, I give unto my son Joseph Boothe my girl Rainy. I wish my fourteen 
negros before mentioned which I have lent my wife, after myself & her 
death is to be equally divided between my seven daughters though my 
daughter Mary Herndon's children to wit Joseph, George, Lewis W., & Mary 
Herndon to be considered same as one of the seven daughters. I desire the 
negros may not be sold but three uninterested persons may ration them in 
seven shares and they may draw for them & the highest may pay to the 
lowest so they have equal shares & I do hereby constitute & appoint my 
worthy friends William Yates & Sampson Moore & Sarah my said wife 
executors to this my last will and testament in witness wherof I have 
hereunto set my hand and seal the day and year above mentioned. Signed 
sealed and delivered in the presence of us
