War of 1812: Captain Bingham

State of New York
Allegany County

On this 28 day of April  AD 1855 before me a Justice of the peace with and for
the State & County aforesaid personally appeared Sarah Downing aged 61 years a
resident of Hume in the State of New York who being duly sworn according to
law on her oath declares that she is widow of Luther C. Downing deceased who
as a private in the Company Commanded by Captain Bingham in the Regiment of
Militia commanded by Col David Demming in the war with Great Britain declared
by the United States on the 18th day of June 1812, that her said husband
enlisted or Volunteered at Royalton Vermont in or about the month of September
1812 for 3 months  and continued in actual service in said war for the term of
three months and was honorably discharged at Plattsburgh in the month of
December AD 1812.

She further states that she was married to the said Luther C. Downing at
Woodstock Vermont on the 24th day of July 1814 by one William Ellis a Justice
of the Peace and that her name before her said marriage was Sarah Cary; that
her said husband died at Hume New York on the 12th day of October 1849 and
that she is now a widow. That she has no record of her marriage with the said
Luther C. Downing.

She makes this declaration for the purpose of obtaining the bounty land to
which she may be entitled under the act approved March 3, 1855.

We John Todd & Mahbere(?)L. Ross residents of Hume in the State of New York
upon our oaths declare that the foregoing declaration was signed &
acknowledged by Sarah Downing in our presence & that we believe from the ap-
pearance & statements of the applicants that she is the persons that she
represents herself to be; that we were acquainted with the said Luther C.
Downing & Sarah his wife in his lifetime & know that they sustained the
relation of man & wife until his death & that since he died the said Sarah has
not intermarried.

          Lucy McNeil being
duly sworn according to law on their oaths depose & say that they were well
acquainted with Luther C. Downing late of the town of Hume deceased that the
said Luther C. died at said town of Hume on the 12th day of October 1849 and
deponents were present at his funeral.  That said Luther C. Downing left a
widow whose name is Sarah Downing & that she is now a widow.
