JOHN SQIRES WILL

In the name of God, Amen, I, John Squires of Nunda in the county of Allegany,
State of New York being of sane mind, and knowing that it is appointed unto
all men to die, do resign my soul to God who gave it, trusting in his mercy,
hoping that through Jesus Christ he will make me a recipient of his good
will---I do hereby make and constitute this my last will and testament--First
I give and bequeth all my personal estate (remaining after settling all my
debts and liabilities) to my beloved wife Amanda Alvina--and do further give
bequeath and assign to her all the estate, right, title and interest to which
I am entitled to the estate of Jesse Squires, deceased, late of Nunda in said
county of Allegany, to have and to hold the same to her use and benefit all of
which I do hereby make, publish and declare to be my last will and testament,
revoking all or any heretofore made.

In Witness hereunto I have set my hand and seal at Nunda this second day of
April in the year of our Lord one thousand eight hundred and forty four. (John

At the request of John Squires, the testator of the above iwll we do hereby
subscribe our names to said will and testament as witnesses thereunto--

Be it remembered that at Allegany County Surrogates court held at the town of
Nunda in the county of Allegany on the 11 day of May 1844, before Samuel C.
Wilson, Surrogate of said county, the last will and testament of John Squires
late of the county of Livingston in said state, deceased, was admitted to
probate and record as a will of said and person estate, after a citation of
the next of kin of the said deceased issued, served, returned and filed
according to law, whereupon on the day and at the place aforsaid, the
following witnesses after having been duly swon by the said Surrogate
testified as follows:---

State of New York

Allegany County, Henry C. Jones being duly sworn, says he was partially
acquainted with the said John Squires in his lifetime---that the signature of
the will here presented is the handwritting of the said John Squires--that the
will was drawn by this witness at the request of the testator and in
accordance with his directions---that the will is the same now as when
executed--witness had several conversations with the said John Squires, upon
different subjects, in all of which he manifested no signs of alienation of
mind, and was in all respects same in mind and memory and fully competent to
devise said estate--that at the time of executing the said Will he declared it
to be his last will and testament, by replying to witnesses when asked if he
made, published and declared it to be his last will and testament, he said he
did--witnesses signed the same as a witness thereto at his request, and in his
presence, and in the presence of the subscribing witnesses.

Allegany County-- Carlos C. Ashley being duly sworn says he was acquainted
with the said John Squires in his lifetime, and was present and saw him sign
his name to the will now presented--that he declared it to be his last will
and testament---that he was at the time of sound mind and memory, though weak
in body---that he was competent to make a disposition of his property--that
witness signed the said will as a witness at the request of the said testator
and in his presence and in the presence of the other subscribing witnesses

Allegany County----Amanda A. Squires, the widow of the said John Squires and
legatee in the said will named being duly sworn says, that the said John
Squires died on the 8th day of April last, at the town of Nunda, in said
county a natural death and that he was at the time of his death or shortly
previous thereto a resident of the town of Mount Morris in the county of
Livingston---that the will now presented here was after it was executed
deliverd to Henry C. Jones, Esq. and by him delivered to witness a few days
after the death of the said John Squires and remained in her possession until
presented to the surrogate for probate and record Amanda A. Squires

Taken, subscribed and sworn

before me on the 11th dayof May 1844

The foregoing proofs and examinations taken before me the Surrogate aforsaid,
at the time and place first mentiond, and the depositions of the respective
witnesses were by them respectively subscribed after having been carefully
read over to them and I, the said surrogate being satisfied upon the said
proof taken, that the said will was duly executed, that the said testator at
the time of executing the same, was in all respects competent to devise real
estate, and not under restraint. Do therefore allow the said will, proofs an
examinations to be recorded. And I do therefore order that the same be
admitted to probate and that letters of administration with the will annexed
be granted to Samuel Swain Jr. Guardian of the said Amanda A. Squires on
complying with the provisions of the statute in such case mand and provided.
