Coats Deceased In the Name of God Amen I Hiram A. Coats of the town of Wellsville Allegany Co. NY being of sound and disposing mind, memory and understanding, do make, ordain, publish and declare this to be my last Will and Testament in manner following, that is to say 1. After all my lawful debts and funeral charges are paid and discharged I give, devise and bequeath unto my brother Waters B. Coats all the rest, render and remainder of my property and estate both real and personal of every kind character and description, whatsoever to have hold and enjoy the same to his own use benefit and behoof his heirs and assigns, forever, excepting only the house and lot hereinafter in the next section mentioned and the bequest to Emma Coats hereinafter contained. 2. I give and devise unto my mother Joanna Coats for her sole use and enjoyment for and during her natural life, the home and lot with the land extending 100 feet in the rear thereof which I now occupy in the Village of Wellsville in the County of Allegany and State of New York. The title in fee simple to said house and lot rests in myself and my said brother Waters B. Coats as tenants in common but in devising the life use thereof to my mother Joanna Coats and the remainder in fee to my sister Caroline W. Coats as is hereinafter provided, I intend to devise the entire and absolute title in fee simple free and clear from any claim interest or title of my said brother and I hereby make the assignment and release by him of all his right title and interest in said house and lot to my devises herein named a condition of the devise and bequest to him herein before contained. 3. I give and devise to my sister Caroline W. Coats after my mothers decease the house and lot herein before described and in which I have given my mother a life estate to have and to hold ____ same in fee simple absolute free from any claim of my brother Waters B. Coats to herself her heirs and assigns forever. 4. I give and bequeath to Emma Coats for many years living with my mother, the sum of five hundred (500) Dollars and to make the same and also the payment of my debts and funeral expenses a charge on the property real and personal herein devised and bequeathed to my said brother Waters B. Coats. In speaking of my debts in this instrument, I wish to be understood as including therein all the debts of the firm of Coats Brothers for which I or my property may be liable and I wish to charge the same to the extent of my liability therefore on my said property in the hands of my said devisee and legatee residency, as aforesaid. Lastly, I hereby make constitute and appoint my Brother Waters B. Coats the executor of this my last Will and Testament and I do hereby revoke all former Wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal the ___ day of June in the year of our Lord one thousand eight hundred and eighty-two. Hiram A. Coats The above written instrument was subscribed by the said Hiram A. Coats in our presence and acknowledged by him to each of us, and he at the same time declared the above instrument so subscribed by him to be his last Will and Testament and we at his request have signed our names as witnesses hereto in his presence and in presence of each other and have written after our names our respective places of residence. NY State of New York Allegany County Surrogates Office Be it Remembered that on the date hereof, the Last Will and Testament of Hiram A. Coats late of the Town of Wellsville in the County of Allegany and State of New York, deceased, bring the within and foregoing written instrument, was duly proved before Clarence A. Farnum Esq. Surrogate of the said County according to Law, as and for the Last Will and Testament of the real and personal estate of the said deceased which said Last Will and and Testament and the proofs and examinations taken therein, are recorded in this office. In Testimony Whereof, the Surrogate of this said County hath hereunto set his hand and affixed his seal of office, this 5th day of December A.D. 1884. Clarence A.
