Record of the Will of JACOB SEARL Deceased.

Death being certain unto all men and the termination of life uncertain and
Just and desiring to give direction of the ownership of my property after my
decease I JACOB SEARL of the town of Belfast in the County of Allegany and
State of New York of the age of eighty four years and being of sound mind and
memory, do make constitute & declare & publish this my last Will and Testament
in manner following, That is to say,

First I give and bequeath to my son ISAAC SEARL all my personal property of 
whatever Kind and condition.

Second I give and devise unto my said son ISAAC SEARL aall my real Estate 
wheresoever located, and particularly a house and lot situated in the town of
New Hudson at a Village called Black Creek in said County of Allegany subjict
(sic) to a contract for the sale of said lot by me made and I hereby charge
upon my said estate a sufficient amount to pay all my honest debts and my
funeral expenses, and direct my executor to pay the same out of the property
so above Bequeathed and devised.

Third I hereby constitute and appoint SAMUEL M RUSSEL of Cuba, Allegany County 
and State of New York my sole executor of this my last Will and Testament with 
full and ample power to sell all real Estate as well as personal should he
deam it necessary so to do hereby revoking all former Wills by me made.  In
witness whereof I have herewith set my hand and Searl this 16th day of June
A.D. 1875.

The above instrument consisting of one sheet was at the date thereof signed 
sealed and declared by the said JACOB SEARL as and for his last Will and 
Testament in presence of us who at his request and in his presence and in the 
presence of each of other have subscribed as witness thereto.

JOSEPH ALLEN, residing at Belfast in Allegany Co., N.Y.

Surrogates Court
In the Manner of proving the last Will and Testament 
of JACOB SEARL late of Belfast in the County of Allegany and State of New York 
Deceased. 

Allegany County S.S. GEORGE RAMSAY and JOSEPH ALLEN of Belfast being first
duly sworn in open Court upon their several Corpereal Oaths, each for himself
doth dispose and say that he is a Subscribing witness to the last Will and
Testament of JACOB SEARL late of the town of Belfast in the County of Allegany
and State of New York deceased, and these deponents do further say that the
said JACOB SEARL deceased did in the presence of each of these deponents
subscribe his name at the end of the instrument in writing which is now here
shown to these deponents, and which purports to be the last Will and Testament
of the said deceased and which bears date on the 16th day of juen one thousand
eight hundred and seventy five, that the said deceased did at the time of
subscribing his name to the said insturment as aforesaid declare the same to
be hs last Will and Testament and these deponents did thereupon Subscribe
their own respective names at the end of said instrument as attesting
witnesses to the execution thereof, each at the request of the said deceased
and in his presence and in the presence of each other:  That the said deceased
at the time of so subscribing his name to said instrument as aforesaid and
publishing said instrument as aforesaid was upwards of twenty one years of
age, and a citizen of the United States; that he appeared to be said deponents
believe he was of Sound mind, memory and understanding, and not under any
restraint and as deponents verily believe in all respects competent to devise
real Estate; that each of these deponents saw the other sign his name to the
said instrument in the presence of the said deceased.

It appearing from and upon the proofs taken in respect to the last Will and 
Testament of JACOB SEARL late of the town of Belfast in the County of Allegany 
and State of New York deceased that the said Will was duly executed and that
the said JACOB SEARL the said testator at the time he exected the same was in
all respects competent to devise real & personal Estate and was not under any 
restraint.  The said Will of the said deceased with the proofs and examination 
taken thereon are herewith duly signed, certified and recorded in this office 
pursuant to the provisions of Statutes of the State of new York this 30th day
of March 1876.
