Last Will and Testament of Killian Van Rensselaer
Made: February 22, 1686/7

In the name of God Amen  Bee it Known to all whom itt may concern That in the 
year 1686/7 on the 22th day of the month of February about 12 of the clock at 
night being in the second year of the Reign of James the Second of that name
King of England France and Ireland appeared before me John Becker, Notary
Public admitted by His Excellency Thomas Dongan Captain Gen:el under his Maj: 
__?  aforesaid residing at New York and the witnesses hereafter named Killian
Van Rensselaer Patroon of the Lordship and Mannor of Rensselaerwyck dwelling
there at Watervliet lying sick on bed but useing and having his senses
understanding and memory well to the outward appearance who mindfull of the
frailty of life and the uncertain hour of death being unwilling to depart this
life without disposing of his temporal estate given him by Almighty God
declaring to have made no disposall thereof by deed in writing before thesE
presents bequeathing his soul into the hands of God and his body to Christian
burial  wholly without induction persuasion or delusion of any but his own
free motion doth nominate and appoint by these presents his wife Mrs. Anna Van
Rensselaer his only universal and general heir in all his goods & Estate
lyeing standing moveable & immoveable situated & being as well in this county
or upon the sea in Guilderland & elsewhere   giving unto her the full
administration and executorship in every part and manner whatever to disposes
of the same as the Testator in his life time had power to do  without giving
account or Inventory much less putting in Caution or security to his kindred 
the authority of the Citty of Albany  the overseers of orphans  the Constable
or Constables or any other officer of Justice or authority of what now serves
or of what nature serves or wherever the same may be who generally and in
particular he excludes and debars any law or laws to the contrary not
withstanding which in this behalf itt is his will that they be of __ 
______   

Item  The Testators wife shall first have and enjoy all the Testators goods in 
this country upon the [inserted "Sea"] and the estate exepected to arrive here
in the yeare 1886/7 comprehending herein linnen Wood __ funiture cloths
household stuff  sylver [silver?]and gold as well coyn_[coined?]  ___ as
uncoined jewells and [blank space]   

But his wife forthwith of the rest of the estate and goods lying here in 
Gelderland and elsewhere shall suffer his sister Nelle Maria born at New Kerck 
and now dwelling at Amsterdam to have and enjoy one full moyety [moiety] or
half part in which is comprehended the Testators part of intailed estate lying
beyound sea in Gelderland together with all obligation  _____? and  creditts
and also that _______ concerning the money that his father, deceased, hath
disbursed for the Lordship and Manor of Rensselaerwyck  upon which an award is
made and consented to and approved by the Testator and Mr. Richard Van
Renselaer 

His wife shall deliver to his sister a true account and Inventory of the
estate here and his sister shall do like to his wife of the estate beyond sea
in the Netherlands & it is to be understood that the lands lying here in the
Lordship and Manor of Rensselaerwyck, belonging to the Testator shall be
divided of which that part that has come to him by inheritance shall go to
Hendrick Van Renselaer, son of his uncle Jeremy Van Rensselaer of the proffits
whereof he shall deliver to the Testators wife during her life the one the
moyety [moiety] or equal half but the lands that the Testator has by purchase
thereof his wife shall suffer his said sister to have and enjoy one moyety
[moiety] or equal half.

Item   In case the Testaors sister shall happen to dy without issue the real 
estate that shall fall to her after his death shall revert to the Children of 
Jeremy Van Rensselaer the son of John Babtist Van Renselaer and the children
of Do. Johannis Carlinnius.

The Testator's part or division of the ground or Toft of land in Clein 
Ooverhoost, lying in the Ampt, Van Barnvelt, in the Naspell Van Voorthuysen 
also his  division of the house or Toft of ground lying & sittuated New Kerck
by the stone bridge between the houses of Tunis the Cooper and Roelofs
deceased shall be and ensure for a legacy to all the heirs of his blood
excepting those of the family of Jeremy Van Renselaer the son of John Babptist
and D. Johannis Carlinnius   in case his sister aforesaid happen to dy without
issue whereas the Testator and his said Sister have promised their aunt by
name Petronelle Van Twiller dwelling at New Kerck to take care of and honestly
to maintaine her during her life  itt is his desire that his said aunt shall
have the one half of her said maintenance during her life out of his whole
esatate

In Case the Testator happen to leave issue by his wife they shall inherit 
according to Law   if it so be he shall nott leave issue by his said wife &
shee remarry has a child or children and they happen to dy without issue the
estate shall revert to the fa___ of  _______  Van Renslear

All the before written the Testator declares to be his last will & Testament 
which itt is his will shall be the most e____  to the last clause therein   
be itt as a Testament _____  _____  in case of death or among the living or in
any other manner notwithstanding all forms used in the law be not herein
observed  requesting the most favorable construc[t]ion to make the same firm
and stable  In testamony of the truth hereof he hath signed and sealed the
same with his own hand in the presence of M'r. Martin Gerritts Justice of the
pease  M'r: Hendrick Van Ness Old Commissary & M'r: Jacob Stadts Chyurgeon in
this Citty of Albany Witnesses worthy of good faith to me the Notary well
Known who met?  the Testator have signed these presents  Thus This was
pen[n]ed att Watervliet lying in the Lordship & Mannor of Resselearwyck 
Dated the 22 th  Febrary 1686/7 as beforewritten.

The Last Will and Testament of Killian Van Rensselaer of the Manner of 
Rensslaerwyck Esq. in the County of Albany deceased was Produced in Court, & 
Proved by the Oaths of Martin Gerrits Esq.: Justice of the Peace, Hend: Van
Ness, & Jacob Stadts witnesses thereto & his wife M'rs. Anna being therein
named was approved to be Executrix thereof, & ordered that the same will be
recorded, and shee ref__d  to his Exell: the Goven'r for further confirmation
of the Probate 
thereof.

ADDITIONAL COMMENTS:
I believe this Killian Van Rensselaer was the s/o Johan Van Rensselaer & 
Elizabeth Van Twiller. Killian married Ann Van Rensselaer July 18, 1686, in
the Albany Reformed Dutch Church, Albany, NY. Ann was the d/o Jeremiah Van
Rensselaer & Maria Van Cortlandt and therefor his first cousin by half blood. 
Ann Van Rensselaer, widow of Killian Van Rensselaer, married William Nicoll
July 5, 1688, Albany Reformed Dutch Church, Albany, NY., by whom she had
issue.
