LAST WILL OF DANIEL BENNETT DATED 15 JANUARY 1813
RECORDED AT ALBANY, NEW YORK ON 30 NOVEMBER 1814

Note:  This document was transcribed from hand-written copy on file with the 
Albany County Courts in October 2004 by Tom and Carol Lanagan.  Sections of

In the name of God, Amen, I Daniel Bennett of the Town of Bethlehem County of 
Albany and State of New York, being weak in body, but of sound and perfect
mind and memory; do write and publish this my last Will and Testament, in
manner and form following, (which is to say) I want my property to be kept
together, I wish my debts to be paid from and with the produce of the farm.  I
wish my children to have a good Common Education and live if not all my Days
to be Apprenticed to some good Trade.  I leave and bequeath unto my wife
Abigail Bennett, all my Estate, both Real and Personal so as to enable her to
perform my wishes as above stated.  Which is to say I give the whole as living
in this town as is my widow;  providing this I give her one fourth part of
what my estate with time for future paid to her annually during her natural
life, it is however the _______ and if it becomes _______ which is to say to
______ my wishes in ______ it be therein in any way And it may not be _____
near the Wood cart off;  If my wife Abigail as my widow, I give her my
property to my children each an equal part to be divided to them or their
heirs.  Promised other __________ gives her one fourth as above stated this
Reminder to be equally divided between my children when the youngest becomes
of age.  If my wife marries and this property is given or divided after her
receiving the one fourth of Tracts this _______ must be _________ to the
______ and benefit of my children equally when the youngest becomes of age;
_______ as above I do appoint Mr and Mrs Rushmore ________ Executors and my
wife Abigail Executrix of this my last Will and Testament:  In witness thereof
I have here unto set my hand and seal this fifteenth day of January in this
year of our Lord one thousand eight hundred and thirteen.

Additional Comments:
Daniel Bennett was born to a yeoman farmer at Falfield Green on the main road 
from Bristol to Gloucester England and emigrated to Albany NY in 1802 where he 
hired on with the Rushmore farm near New Salem and subsequently married
Abigail Rushmore and purchased an adjacent farm on the south side of the
Rushmore farm that was in the town of Bethlehem.
