BLANCHARD, of ALBANY, re: JOHN DAVIS The Last Will and Testimony of JOSEPH SALISBURY JR, Proved and Recorded OCTOBER 28th 1850 as a will relating to both Real and Personal Estate In the name of God, Amen! I, JOSEPH SALISBURY JUNIOR of the Town of BETHLEHEM, in the County of ALBANY being of sound and disposing mind and memory, do make and publish this my Last Will and Testament, in manner and form following, to wit: FIRST: I order and direct that all my just debts and funeral expenses shall be paid by my Executors hereinafter named as soon as may be practicable after my decease. SECOND: I give, devise and bequeath unto my two SONS JOHN SALISBURY and JACOB SALISBURY, all my real and personal estate. To have and to hold the same to them, their Heirs and Assigns forever share and share alike, subject nevertheless to the payment of the legacies and annuities hereinafter named, to wit: FIRST: I do order and direct that my said two Sons shall in a comfortable manner support my beloved WIFE GITTY and provide her with sufficient boarding and lodging and apparel during her natural life, and that they shall pay to her the sum of twenty dollars annually in semi-annual payments during her natural life. SECOND: I do give and bequeath unto my SON JOSEPH SALISBURY the sum of one hundred dollars, to be paid to <____> his Executors or Administrators within one year after my decease THIRD: I do give and bequeath to my DAUGHTER MARY SLAYTER the sum of fifty dollars, and to each of my DAUGHTERS to wit, NELLY the WIFE of THOMAS <MILVAIN>, HANNAH the WIFE of VALENTINO OLIVER, and GITTY the WIFE of DANIEL FOSTER the sum of twenty five dollars, to be paid to them respectively within one year after my decease. I also give and bequeath to my GRAND-DAUGHTER POLLY SLAYTER the sum of twenty five dollars to be paid to her within one year after my decease. FOURTH: I do order and direct that my said two SONS JOHN SALISBURY and JACOB SALISBURY shall support and clothe my SON HENRY SALISBURY <MISSING TWO LINES> my said two SONS JOHN SALISBURY and JACOB SALISBURY are subject to the payment of the annuities, legacies and support of my said WIFE GITTY, and my SON HENRY in the manner above mentioned. FIFTH: I do direct that in case either of my said Sons shall be disposed to sell his share or half of my said Real Estate he shall offer the same to the other at such reasonable price as the same shall be deemed fairly worth, and that a reasonable <__dit> for payment shall be given to the purchaser by the seller. Lastly, I do constitute and appoint my said two SONS JOHN SALISBURY and JACOB SALISBURY, EXECUTORS of this my Last Will and Testament, hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this eleventh day of June one thousand eight hundred and forty one. TEUNIS VAN VECHTEN of the City of ALBANY in the County of ALBANY being first duly sworn in open court doth depose and say that he is a subscribing witness to the instrument now shown to him purporting to be the Last Will and Testament of JOSEPH SALISBURY JR. of the Town of BETHLEHEM in the County of ALBANY. That the said JOSEPH SALISBURY JR. did in the presence of this deponent subscribe his name at the end of the instrument which is now shown and exhibited to this deponent as aforesaid and which purports to be the Last Will and Testament of said JOSEPH SALISBURY JR. and which bears date on the eleventh day of June in the year of our Lord one thousand eight hundred and forty one. And this deponent further saith that the said JOSEPH SALISBURY JR. the said Testator did at the said time of subscribing his name as aforesaid at the end of the said will declare the said instrument so subscribed and now exhibited to be his Last Will and Testament, and this deponent did thereupon subscribe his name at the end of the said will as an attesting witness thereto, and at the request of the said testator. And this deponent further saith that at the said time, when the said testator subscribed his name to the said Last Will as aforesaid, and at the time of the deponents subscribing his name as an attesting witness thereto as aforesaid, the said JOSEPH SALISBURY JR. was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent, and further this deponent saith not. TEUNIS VAN VECHTEN Sworn and subscribed this 28th day of October 1850 Before me, LEWIS BENEDICT JR. SURROGATE ALBANY COUNTY S.S. ROBERT G. BLANCHARD of the City of <_______>, being first duly sworn in open court, doth say <_____MISSING ONE LINE_________> LEWIS BENEDICT JR. SURROGATE of the County of ALBANY, says that he was well acquainted with JOHN DAVIS late of ALBANY who is said to be deceased and with his manner and style of handwriting, having seen him write and he verily believes that the signature JOHN DAVIS signed as a witness to the instrument in writing now produced and shown to this deponent, bearing date eleventh day of June A.D. 1841, purporting to be the Last Will and Testament of JOSEPH SALISBURY JR. late of the Town of BETHLEHEM deceased is the true and genuine hand writing and signature of the said JOHN DAVIS.
