Will of Isaac Errett 2840

 "In the name of God Amen I Isaac Errett of the County of Westmoreland  
State of Pennsylvania, former - being week in body and of sound mind 
memory and understanding, but considering the uncertainty of this 
Transitory life, do make and publish this last will and Testament 
in manner and form following  To wit: First  It is my will, and I 
do order that all my just debts and funeral expenses be duly paid 
and satisfied as soon as conviently can be after my decease -   
Item - 
I give and bequeath unto my beloved wife Hesterann Errett, 
a certain lot of land lying East of the public Road, adjoining lands 
of David Hance, and Isaac Fox and the home farm containing about 
three acres. She to have and To hold the same so long as she remains 
my widow, and if she should again marry before her death then it 
is my will that it shall fall back To my heirs and be equally divided 
between them,  Also she the said Hester Ann my wife,  To have four 
hundred dollars out of my Estate for building purposes on said lot -    
Second -  
My oldest daughters Mary Jane, & Lucinda of the first wife to have 
one hundred dollars each it being money due them from their Mothers Estate, 
the said Lucinda to have Eight dollars stricken of her hundred for her 
mothers bureau, and she to have it.  the said Lucinda To have one hundred 
dollars worth of furniture.  
Third 
It is my further will that Susan and Sarah of the second wife each 
To have one hundred dollars worth of house furniture -  
Fourth 
It is further my will that my sons Adam and David, William Each To 
have one hundred dollars in money making it equal with the girls furniture -   
Fifth - 
And further my wife is now pregnant and likely To be delivered of a 
child which if living and doeth live  To share equally with the rest -    
After all the expenses of settling my Estate is paid  Both Boys and Girls 
to share, share & share alike  
Sixth - 
It is further my will that John Errett my brother would except the trust 
of guardian of all my minor heirs, and further it is my will that my Executor 
hereinafter named in nine months after my decease, Put all my Property both 
Real and personal to sale and settle with the Court as soon as it can be 
brought about, and further it is my will that the guardian would pay over 
the girls money, when they attain the age of Eighteen years - providing they 
should marry at or before that age, and if they don't marry before twenty one 
to hold it to that time, and the boys to be satisfied according to law at the 
age of twenty one years -   The word twenty one on the part of the boys revoked 
and the money to be handed over at the age of Ninteen years -   And further it 
is my will that my Executor shall superintend the building of a house on the 
within named lot of ground for the use of my wife and to use the means herein 
provided for that use,  To the best advantage  and Return the overplus if any 
to my beloved wife,  And my children to remain with their Mother and make 
their home with her so long as their Guardian thinks they are treated right.    
And further it is my will that my beloved wife,  Takes three hundred dollars 
worth of household furniture at the appraisement of my property, and receive 
the interest of the one third of the Real Estate as it becomes payable from 
year to year so long as she remains my widow;  And further it is my will that 
the within named Guardian, Receives the interest of the third as it becomes 
due & sees that it is appropriated for my wife's use and my heirs.  And also 
I do hereby constitute and appoint John L. Hartzel Executor of this my last 
will and Testament.  in witness whereof I have hereunto set my hand and seal 
this Twenty first day of May one thousand eight hundred and sixty nine"

 "Signed, sealed and declared by the said testator as his last will & testament 
in the presence of us - John Errett - Andrew Heighbarger"

 "This is to certify that I  Isaac Errett of the Township of Hempfield 
Westmoreland County & State of Pennsylvania,  Farmer, did on the 21st day 
of May 1869 make my last will and Testament, and in that declaration did 
appoint my brother John Errett to except the trust of Guardian for all 
my minor heirs, and upon a due consideration of the matter and consulting 
my brother, through his request, it is my will and next choice To appoint  
John T. Fulton - asking him to except the trust of Guardian of all my minor 
heirs and in every Respect perform the duties of that trust as is set forth 
in my original will directing my brother John how to proceed -  Given under 
my hand and seal this 24th day of May Ano 1869 Signed, sealed & declared in 
presence of us "
