Will of James Akin of Scipio of Cayuga Co., N.Y.
Bequest. David Akin, son and his wife Polly use of 54 acres of land situated
in Venice township, Cayuga Co., N.Y. which is same land I purchased of Joseph
Pancost of Nathan Webster, Jacob Morgan and of Nathan Morgan.

Also to son David Akin and Polly use of all that part of my real estate at
Woodhull, Steuben Co. and designated on a map accompanying, a deed of the same
as #26, 27, and 28 containing about 357 acres and at their decease to go to
their heirs.

Bequest. Phebe Ann Wood, daughter and her husband (Aniss) or Anias Wood use of
all that part of real estate on lot #38 in Scipio bounded on the south by the
center of the town line between Scipio and Venice and on the north by the
south line of land I conveyed to Oliver Wood containing about 82 acres of land
for and during their natural lives also use of all that part of my said farm
in said town of Woodhull designated on map A as lot #38 and containing about
126 acres of land for their life time and I also give devise and bequest them
use of rest and residue at Woodhull of my west farm containing about 117 acres
of land on said map as lot #39 during their lives but this last bequest is
upon the condition that Phebe and Anias shall within 5 years after my decease
pay to the children and heirs at law of Edward Akin, deceased the sum of $500
and at the decease of said Phebe Ann and Anias I give devise and bequeath the
1st above described piece of land in Scipio of 82 acres on lot #38 to my
grandson Oliver Wood to him his heirs and assigns forever but this bequest to
the said Oliver is in consideration that Oliver pay to his brother Lewis Wood
sum of $1,000 and to each of his sisters Lavisy and Sarah (then Lavisy is
crossed out) each $500 and these sums to be paid 5 years after decease of
Phebe Ann and Anias.

I also give devise and bequeath to Lewis Wood, Oliver Wood, Lovicy Cranison
and Sarah Wood the same real estate in Woodhull the use of which I have given
to Phebe Ann and Anias during their life times.

To daughter Elizabeth Merrills and husband Noys M. Merrills part of lot #38 in
Scipio on which they now reside which purchased of Slawson Howland of about 76
acres of land.

To daughter Hannah Gould and husband D. C. Gould (This is Dewitt C. Gould) use
of that part of my real estate in Scipio which my son Edward Akin dec'd of
about 75 acres of land during their lives and I also give devise and bequeath
to Hannah and D. C. Gould use of 6 acres situate at Batts (or Balls) Corners
in Scipio which I purchased of Jothan Merrit for and during their lives and to
be left their heirs.

I do bequeath to my grandchildren Martha Akin, Lovicy Akin and Elizabeth Akin
infant children of Edward Akin deceased one certain bond and mortgage which I
hold against Oliver Wood executed by same on or about 25 Aug. (1858) and given
to secure the payment of $3,000 and interest to grow due thereon. I also give
to Martha, Lovicy and Elizabeth $500 mentioned in bequest to Phebe and Anias
to be paid by said Phebe and Anias.

I give to Lewis Wood, Lavisy Cranson and Sarah Wood the said several sums to
be paid by Oliver Wood and in case he fails to pay the same as directed then
the 82 acres to be equally divided between said Lewis, Lavisy, and Sarah in
payment of same to them.

I reserve from bequest of the 82 acres to Phebe Ann and Anias that part of
said 82 acres being a burying ground containing about 1/4 of an acre of land.
I also will and direct that if my daughter Elizabeth die having issue that the
real estate to go them (issue) of said Elizabeth and Noys M. Merrill.
All rest and residue to my children to wit David Akin, Phebe Ann Wood and
Hannah Gould.
