The People of the State of New York: To Jacob Jacoby, Mariah Dikes of
Bradford Steuben County, N. Y. John Jacoby of Wheeler, in said County of
Steuben, Stephen Jacoby + Martha Rarick of Orange, Schulyer County, N.
Y. Sarah Jane Baker of Penn Yan, Yates Co N. Y. Augustus T. Barnes,
Special Guardian for James Lake, Emeline Lally Adaline Lake + Margaret
Lake, of Bath, Steuben Co N. Y. Irene Inscho or Lingham of the city of
New York + Elizabeth Kelly of Tioga Co., Pa. the children + heirs at Law
of Jacob Jacoby late of Steuben Co De'd.
     Whereas Moses T. Van Kiren on of the executors of the last will +
testament of Jacob Jacoby dc"- Has this day offered the said will for
probate before Wellington(?) Barnes Surrogate of our County of Steuben,
you are therefore hereby cited to appear before the said Surrogate at
the Surrogate's Office, in the Town of Bath, in said County, on the 13th
day of August next at 10 o'clock in the forenoon, to attend the Probate
and Proof of said Will which relates to real + personal estate.
     Given under the hand of the said Surrogate and seal of the
Surrogate's Court of said County, this 15th day of August one thousand
eight hundred and sixty.

     In the name of God amen.  I Jacob Jacoby of the town of Bradford in
the county of Steuben and State of New York of the age of eighty years
being of sound mind and memory do make publish and declare this my last
will and testament in manner following, that is to say:
     First: I give and devise to my son Jacob Jacoby one half of my real
estate being one hundred acres of land situate in the said town of
Bradford bounded as follows on the west by the lands of Jacob Weeton, on
the north by the lands of Moses Van Curen on the east by the land of
Elijah Wortman, and on the south by the lands of John Kishbaugh being in
the southeast corner of the Whittaker tract being the same farm that I
Jacob Jacoby now reside on the said farm is to be divided as follows by
running a line from east to west through said farm and my son Jacob is
to have the north half of said farm supposed to be forty-nine acres of
land in the said one half together with all the here ditaments(?) and
affurenances(?) thereunto belonging or in anywhere appertaining to have
and to hold the premises above described to my son Jacob forever.
     Second: I give and bequeath to my sons Stephen Jacoby and John
Jacoby each ten dollars to be paid out of my personal property one year
after my decease and to my daughter Elizabeth I give and bequeath one
hundred dollars to be paid the same as above.
     And Thirdly: I give and bequeath all the residue of my real estate
together with my personal property of whatever name or nature after
paying all my debts that I may be owing at the time of my decease
together with the funeral charges such as grave stones and grave clothes
and coffin + all necessary funeral charge to my said son Jacob Jacoby
and my daughters Martha Rarrack Mearia Dikes and Ireana Insco to be
divided equally between then share and share alike.
     And lastly.  I do hereby nominate and appoint my friends Moses S.
Van Kuren and Elijah Wortman to be the executor of this my last will and
testament hereby revoking all former wills by me made.  In witness
whereof I have hereunto set my hand and seal this third day of May 1860

     The above instrument containing one sheet was at the date thereof
signed, sealed published and declared by the said Jacob Jacoby as and
for his last will and testament in the presence of us who at his request
and in his presence and in the presence of each other have subscribed
our names as witnesses thereto.

     The foregoing, being the last will and testament of Jacob Jacoby,
deceased, and relating to both real and personal estate, together with
the proofs of the execution thereof taken before me, was recorded and is
hereby signed and certified by me this thirteenth day of August one
thousand eight hundred and sixty.

Steuben County/S. Moses T. Van Kuren + Elijah Wortman being sesually(?)
duly sworn do the de- depose + say + each for himself says that he is
one of the executors of the legal will + testament of Jacob Jacoby late
of the town of Bradford Dec + that the annexed account according to the
best of his knowledge + belief contains a full + true statement account
of all his receipts + disbursements on account of the Estate of said
deceased + of all sums of money + property belong to the Estate of said
deceased which have come to his hands possession or knowledge as such
Executors or which have been recieved by any other person by his order
or authority for his side + that he do the not ...... of any error or
omission in the said account to the prejudice of any of the parties
interested in the Estate of the said deceased that the sums charged
under twenty dollars in said account for which no nrieluis(?) are
produced have actually been disbursed by him as charged -
