No. 474 Will of Samuel FORDYCE, dec'd

In the name of God amen I Samuel Fordyce being weak in body 
but of sound and disposing mind, Do make and Constitute this 
my Last Will and Testament in the following words to wit 
principally and first of all I commend my immortal soul to 
God who gave it and my Body to the Earth to be buried in a 
Christian like manner at the discretion of my Executor 
herein after named. And as to such worldly Estate as it hath 
pleased God to bless me in this life with I give and dispose 
of the same in the following manner to wit, I will that all 
my debts and burial expences be duly paid as soon as 
conveniently can be after my desease. I give and bequeath 
unto my Children James, Caty, Mary, William, Elizabeth and 
Samuel the sum of One hundred and fifty dollars to be 
equally divided between them or the survivors of them or 
their heirs. I give and bequeath unto my daughter Abigail 
the sum of three dollars. I will and devise unto my son 
Abraham the sum of one hundred dollars to be paid him if he 
should loose the land I gave to him on the waters of Ten 
Mile by any adverse claim after my desease. I will and 
bequeath unto my son Jacob my undivided half of the land on 
ten Mile waters where the said Jacob Fordyce now lives 
provided he will pay unto my Legatees above named the sum of 
One hundred and fifty dollars within a reasonable time after 
my desease but in case of his neglect or refusal to pay the 
said Sum as aforesaid I then order and direct that the said 
Land be sold for such price or prices as can reasonably be 
gotten for the same, and the money arrising therefrom to be 
applied to the Legacies by me heretofore made. I will and 
bequeath to my son William my wearing apperrel and to my 
Daughters Mary + Elizabeth my bedding and house furniture, 
and as to the remainder of my Estate I hereby direct that 
the same be equally divided between my aforesaid children 
namely James, Caty, Mary, William, Elizabeth, and Samuel, 
and lastly I constitute and appoint my son John + Samuel 
Executor of this my last Will and Testament hereby revoking 
all former Wills and Legacies by me heretofore made 
ratifying and declaring this to be my Last Will and 
Testament. In Witness whereof I have hereunto set my hand 
and Seal this 7th day of November 1822.

On the 14th day of December in the year of our Lord one 
thousand eight hundred and twenty four before me Kenner S. 
Boreman Register for the Probate of Wills + granting Letters 
of Administration in and for said County personally came 
Justus G. Fordyce + Harvey Fordyce the Subscribing Witnesses 
within named and on their Solemn Oaths did depose and say 
that they were present and saw and heard Samuel Fordyce the 
Testator within named Sign, Seal, publish, pronounce and 
declare the within Instrument of Writing as and for his last 
Will and Testament and that at the time of doing thereof he 
was of sound and disposing mind, memory, and understanding 
to the best of their knowledge, Observation and belief.
