Written: March 14, 1826

In the name of God Amen I John Winegardner of St. Clair Township Bedford 
County and State of Pennsylvania being in good health of body and of serious 
and disposing mind and memory praise be to God for the same. And being 
desirous to settle my worldly affairs whilst I have strength and capacity so 
to do, do make and publish this my last will and Testament hereby revoking all 
other wills by me at any time before made. And first and principally I commit 
my soul into the hands of my creator who gave it and my body to the earth to 
be interred at the discretion of my Executors hereinafter to be mentioned. And 
as to such worldly estate wherewith it has pleased God to bless me I dispose 
of the same as follows viz I will that all my just debts as shall be owing by 
me at my death together with my funeral expenses shall in the first place out 
of my personal estate and effects be fully paid and satisfied. I will and 
direct that all my estate, real and personal be retained by beloved wife Mary 
for her own proper use so long as she remains my widow except two horses and 
one wagon, that is, such as she thinks she will stand in need of and the 
remainder to be sold by my executors and the money arising from the sale 
thereof to be equally divided amongst my six children namely Anna, Katharine, 
Margaret, Mary, Peter and Elizabeth. I will and direct that after my widows 
decease that all that remains of my personal Estate be also sold by my 
Executors and equally divided between my children above named. I will and 
direct that my son Peter Winegardner shall have two horses and one wagon over 
and above his equal share with the other children. I will and direct that 
after the decease of my widow that all my Real Estate be sold as soon as it 
can conveniently be and the monies arising from the sale thereof be equally 
divided between my six children above named share and share alike. And I make 
and Ordain Joseph Blackburn and James Moore executors of this my last will & 
Testament in witness hereof I have hereunto set my hand and seal this 14 day 
of March A.D. 1826.

Personally came before me the subscribing Register for the Probate of Wills in 
and for said county Anthony Blackburn Esq. and Thomas Blackburn the 
subscribing witnesses to the foregoing instrument of writing and being duly 
affirmed according to Law do depose and say that they were personally Present 
and heard and saw the Testator John Winegardner sign by making his mark , seal 
publish and pronounce the foregoing instrument of writing as and for his last 
will & Testament that at the time thereof  the Testator was of sound and 
disposing mind memory and understanding according to the best of deponents 
knowledge and belief-That they signed their names thereto as witnesses in the 
presence of the Testator at his request and in the presence of each other.

Be it remembered that on the 30 day of April in the year of our Lord one 
thousand eight- hundred and thirty-eight Letters Testamentary were issued to 
the Executors in the foregoing will named they having been first duly affirmed 
according to Law.
