Jacob Moyer's Will

In the name of God, Amen, I Jacob Moyer of Hopewell Township, Bedford County 
and State of Pennsylvania, Being sickly and weak in person, But of sound and
disposing mind and memory, Blessed be God for the same, do make and publish 
this my last will and testament, in manner and form following, viz. 
Principally and first of all, I commend my immortal soul into the hands of 
God who gave it and my body to the earth to be buried in a decent and 
Christian like manner at the discretion of my Executors hereinafter named; 
and to such worldly estate wherewith it hath pleased God to bless me in this 
life I give and dispose of the same in the following manner Viz. I order and 
it is my will that all my Just debts and Funeral charges be paid and adjusted
as soon as possible after my decease; I give and devise to my dear and 
beloved wife Catharine one third of all the income of my real estate during 
her natural Time, further I give her the mill place and mill where we 
now live to her use to her heirs and assigns forever, with one cow of her 
choice , one bureau and other furniture sufficient for table use.  I give and
devise to Eliza Whitford a blind Girl raised by me, one fifth of all my 
estate for and during her natural life with the incomes of the [something is 
missing here] of the nobplan during the same  I give and devise to my Brother
Martin one dollar.  I give and devise to my sister Elizabeth Swartz 
one dollar.  I give and devise to my Nephew John  Moyer a certain tract of
land called in the patent new London containing 129  Acres and allowance, I 
give and devise to Jacob Griffith two horses , two horses and all my
carpenter
and blacksmith tools. And distilling utensils, at the decease of my wife 
Catharine and the nobb place at the decease of the blind Girl Eliza Whitford 
the one fifth part of her share then falls to Jacob Griffith, his heirs and 
assigns forever, I give and devise to my nephew and miss sons and daughters 
of Martin Moyer namely Martin and Limon Barbara and Mary each one dollar I 
give and devise to my nephew Mathias Moyer 150 acres of land part of the 
ract of 294 acres 129 perches called Moyertown being the west end of said 
tract including his improvements on which this said Mathias now lives.  I 
give and devise to the children of my nephew Jacob Moyer as follows Viz.  
To Polsen  100 acres part of my old tract called Derry including my old 
mprovements  To John 101 acres 20 perches remainder of the above named 
tract and 61 acres 15 perches adjoining the above called Fallowfield to 
Martin 100 acres of Patented Land called Mountj of to Susanna 144 acres 136 
perches the remainder of 294 acres 136 perches called Moyerstown I give and 
devise to my nephew Jacob Griffith the small tract of unpatented land
adjoining
Abel Griffith estimated at about thirty acres surveyed on a warrant for 50 
acres to him his heirs and assigns forever.  All my personal property not 
heretofore devised, I allow to be sold at Ven due and the proceeds thereof 
to be given to my wife Catherine and Eliza Whitford for their further support
and maintenance as well as the one third and one fifth and all other before 
mentioned, it is my will and desire it shall be faithfully applied to the 
same purpose.  I do hereby nominate constitute and appoint my trusty friends 
Ezra A. Pipes and Jacob Griffith Executors of this my last will hereby 
revoking all other wills, legacies and bequests by me heretofore made and 
declaring this and no other to be my last will and Testament.  In witness 
whereof I have hereunto set my hand and seal this 27th day of December A.D. 
1825.

Bedford County SS.  Personally appeared before the subscriber Register for 
the probate of will and granting Letters of Administration in and for the 
said County Edward Pierson who being duly affirmed deposeth and waith that on
the 27th day of December 1825 Jacob Moyer the testator Requested him this 
ffirmand to write his will and give him particular directions Respecting the
same and that the within and foregoing written by this affirmant is written 
agreeably to the directions of the testator Jacob Moyer, that at the time
said
estator spoke to deponant to write his will as aforesaid.  He had a will in
writing which he said he wished altered and shured the same to his deponant, 
and pointed out the alterations which he wished made and that said testator 
had about three months proving Request a this deponant to write him a will 
nd make the said alterations and that deponant wrote a will according to 
the directions of said Jacob Moyer  which is the within and foregoing 
instrument and contains the alterations aforesaid, that deponant then
explained
and pointed out that part of the within instrument of writing to the testator
which contains said alterations and are as follows and Further I do give her 
the mill place and mill where we now live to her use her heirs and assigns 
forever and also in the 26th line as follows I give and devise to Jacob 
Griffith two horses and all my Carpenter and blacksmith tools and distilling 
utentials  at the decease of my wife Catharine, and the nob place of the 
dream[?] of the blind girl Eliza Whitford for his his heirs and assigns 
forever.  I do appoint Jacob Griffith Guardian for the blind girl Elizabeth 
Whitford and to devise her income as before mentioned in this will after the 
decease  of the little blind girl Eliza Whitford the one fifth part or share 
then falls to Jacob Griffith his heirs and assigns forever and also in 50th 
line of said instrument of writing this I give and devise to my nephew 
Jacob Griffith the small tract of unpatented land adjoining Abel Griffith 
estimated at about thirty acres surveyed on a warrant for 50 acres to him 
his heirs and assigns forever that after deponant had written the foregoing 
will or instrument of writing, he took it to the said testator and mentioned 
the alterations and he said it was Right and he would sign it that the the 
testator was Raised up in his bed to sign the same but took a fainting spell 
before he had time to sign his name to said instrument of writing and was not
able  to sign it afterward, that the testator Jacob Moyer, at the time of 
giving the directions for drawing a new will with the alterations before 
stated and at the time the alterations  were pointed out and explained to him
was of sound and disposing mind memory and understanding according to the
best 
of this affirmants knowledge and belief.
