WILL OF THOMAS KINTON

Bedford, Bedford County, PA, Vol. 2, page 1.
Will written: July 1, 1817
Probated:  August 2, 1819

In the name of God Amen.  I   THOMAS  KINTON   of the township of Napier in
County of Bedford and State of Pennsylvania former being sick and weak in body
but of sound mind, memory and understanding, blessed be to God for the same,
but considering the uncertainty of this transitory life and that it is
appointed for all men once to die, do make constitute and appoint this my last
Will and Testament in manner and form following to wit:
Principally and first of all I command my immortal soul unto the hands of God
who gave it and my body to the earth to be buried in decent and Christian like
manner at the discretion of my executors here in after named and as to such
worldly estate where with it hath pleased God to bless me in the life I give
and dispose of the same in the following manner to wit:
First I will and bequeath to my wife RACHEL KINTON all my personal estate
after my debts is paid out of it, if she should survive me and any part of
said personal estate that may remain is to be disposed of as she shall think
proper at me decease. 
Secondly, I will and direct that the land where on I now live may be sold as
soon after my decease as it can with advantage reserving unto my son   JAMES
KINTON  the land he now lives on being about thirty-two acres purchased of me.
Thirdly, it is my will that the purchase money of the said land whereon I now
live when sold shall be divided into five equal parts one-fifth part shall be
taken out of the first payment made for the said land which part shall be put
in trust for the use of my said wife   RACHEL KINTON   and if the interest of
said fifth part should not be sufficient to keep her she is to be allowed
yearly as she will stand in need of the principal.  
The remaining other four parts is to be paid in manner following viz:  
One-fifth part to my son   JOHN KINTON   and one-fifth part to my son  ROBERT
KINTON, one-fifth part to my son   JAMES KINTON,   one-fifth part to my son
SAMUEL KINTON.   And further it is my will that if my before mentioned my  son
JAMES KINTON   doth not pay over to my Executors the sum of twenty dollars per
acre for the thirty-two or three acres where on he no lives then the said lot
is to revert back to my estate he first being paid the value of his
improvements and when sold the product thereof added to the part and divided
as before and further it is my will that on the decease of my wife  RACHEL
KINTON  should she survive me the before mentioned one-fifth part if the
purchased money of my land reserved for her use shall be equally divided
between my before mentioned four sons if remaining full if not what is left
and I do hereby nominate and appoint  my beloved son   JAMES KINTON  and
friend Joshua PURSON [Pierson] my Executors of this my last Will with full
power after my decease to sell and convey all my lands and do perform all
things in law good justice hereby revoking all other Wills here to made by me.
In witness were of I have here unto set my hand and seal this 17th day of July
in the year of our Lord one thousand eight hundred and seventeen.

Personally appeared before me the subscribed Register of Probate of Will and
granting letters of administration in for said County  JOHN KINTON, Senior,
and  JAMES KINTON, Junior, the subscribing witness to the instrument in
writing who being duly Sworn do depose and say that they were personally
present and heard and saw  THOMAS KINTON  the testator sign [by making his
mark] seal publish and declare the within instrument in writing as and for his
last Will and Testament.  That at the time of doing whereof the said Testator
was of sound and disposing mind, memory and understanding according to the
best of the dependents knowledge and beliefs and they subscribed as witness in
presence of the testator.
Sworn and subscribed this second day of August A.D. 1819.

Be it remembered that on the second day of August A.D. 1819 Letters
Testimentary were granted to James KINTON & Joshua Purson, [Pierson] Executors
in the foregoing will named they having been first duly qualified according to
law.
