Bedford Estate records 1829-41

In the name of God Amen, this nineteenth day August 1829 I Cadwallader Evan 
Senior of Providence township, Bedford County Commonwealth of Pennsylvania, 
being weak in body but of a sound mind, memory and understanding, thanks be to 
All Mighty God for this memory, but calling to mind the mortality of my body and 
knowing that it is appointed for all men to die, I do make and ordain this to be 
my last will and testament. The ?????? Where of I give in the following manner. 
That is to say first I give my soul into the hands of the All Mighty God that 
first gave it to me and as for my body, I commend it to the Earth, to be buried 
in a Christian like manner at the direction of my Executors. And as for such 
goods as it has blessed God to bless me with in this life, I give in the manner 
following, First it is my will that all my just debts and my funeral expenses be 
paid as soon as convienient as can be after my deceace and as for the rest of my 
property I give it in the manner following. Item, I give to my eldest son David 
two hundred and four acres of Patent land it being the track I live on with all 
the improvements thear upon it and also 44 acres out of the tract I hold by 
warrant laying to the Eastward of the Patent tract and to be taken of joining in 
the Patent land forw where my son Pfaar place is all along of equal Wealth 
northward all and I give to him his heirs and assigns to be at their full 
disposal. Except ????? of Philip should be taken from him and then in this case 
it shall be devided as I shall by and by mention -- David is also to keep his 
mother during her lifetime and to find her in all and every Necessary thing that 
shall be counted needful and useful for her support and maintenance during her 
lifetime ????? him to find her a house or room with a bed and a table and all 
things that shall or may be counted needfull and necessary to wit a bed and 
table at her command if she should think proper. ??? to do or live not that he 
shall give her pa or pa ??? each thing that may be wanted but he shall her 
enough of everything that she may want to keep her handsomly and all to be but 
under her command. Item, I give to my son John five dollars, this with the money 
paid for the land he now lives on is his legacy in full. Item I give to my son 
William twenty five acres of Warrented land it being already marked off and on 
which he now lives on. When the Patent is got for the track of land, then he is 
to pay in proportion to the land he gets and then this is to be for him, his 
heirs and assigns to be at their full disposal and this shall be his legacy in 
full, except liberty to the spring and stone quarry which I shall mention by and 
by. Item, I give to my son Even two hundred and nineteen acres of Warrented land 
out of a track of two hundred forty nine acres, I have in the name of David & 
Even my son and on which my son Even now lives. David shall make to his brother 
Even a lawful deed of Conveyance for the same. But if in case David shall fail 
to do this, then it is my will that Even shall have the land that has been 
marked out above for Davids Share and after to take care of his mother in place 
of David and that paid that he take the lot I have marked out for Even and the 
Balance of the land David is to make a deed of Conveyance to Amos McDaniel 
without fee or reward except McDaniel is to pay all the purchase Money in the 
land office his part that he will get. Item, I give to my son Cadwallader twenty 
five acres of Warrented land joining the land I gave to his brother Will and 
which has alredy been marked off to him. I also give him the remainder of the 
Warrented land that thear is beginning at the North Corner of the above lot and 
running the same course that devides his lot from his Brothers place and 
continuing that Course until it comes to Jacob Grub's line and then along it 
until it comes to Snively's line and then along it to William eve or that I gave 
him and then to the beginning this with the other lot I give to him his heirs 
and assigns to be at their full disposal only he sall give his Bros then William 
liberty at anytime and at all times to rig and pitch and lay pipe from the 
fountain of water on the first lot and lead them whereever he may think proper 
for his own use through said lot forever. He shall also give Liberty to William 
his brother his heirs and assigns forever and also to his Brother Pfaar his 
heirs and assigns that they all shall have liberty at any time and all times 
whenever they may think to quarrie as many as they may want for their own use 
without any notification. I also give him $30 to be paid out of My estate to him 
his heirs and assigns. Item, I give and bequeath to my son Philip a track of 
land in the name of Jacob Martin containing one hundred and fifty acres joining 
on the land I gave to Even, for this tract I have a surity deed in the name of 
my son David and for this tract David is to assign his right of the Sherrifs 
deed to his brother Philip. Also I give him the balance of that track (that I 
gave some to David some to William some to Cadwallader and some I shall give to 
Pfaar) to him his heirs and assigns to be at their disposal. But this has been 
in Expectment part against me for the track in the name of Jacob Martin and if I 
should be unfortunate to loose it in a Court of Justice then it is my will that 
David, Even and Will shall buy it for Philip and pay for it out of my estate -- 
But if the price should be too high so that they cannot buy it at a fair price, 
That then it is my wish that and I Command that my Son John lip? shall in all 
things have one equal third of the share of David and Even and each of them one 
equal third also it is my will that my son Even shall devide the place he has in 
Southhampton town that equal with his brother David and Philip and if he sall 
refuse this to do then it is my will that David and Philip shall have as much 
out of plot I have given to Even or shall be judged equal to two thirds of the 
value of that place. Item, I give to my son Pfaar twenty five acres along the 
side of the land I gave to Chadwalladar to him his heirs and assigns to be at 
their full disposal to give him also $50 and to be paid out of My Estate. Item, 
I give to my daughter Hannah one spring house plot, one feather bed and bedding 
for sufficent for it and bed stead, one beaureau, one falling leaf table, six 
Widsor chairs, one cow and $30 in money out of my estate to her, her heirs and 
assigns. Item, I give to my daughter Rachel $20 in money and the rest of my 
personal property. I give to my three sons David, Even and Philip to be divided 
equally share and share alike, and I do hereby invoke and herein make void all 
former wills, by me made or said to be made fully signifying this to be my last 
will and testament. In witnnes of I have hereunto set my hand and seal the day 
and date written above.
