JACOB CLUTS

Bedford County, PA Will Book 4, p. 216-217

In the name of God amen, I Jacob Cluts of the township of Bedford in County of 
Bedford being in good health of body and of sound and disposing mind and memory 
do make and declare this to be my will and testament in manner following, that 
is to say I order that all my just debts, funeral expenses and charges of 
proving this my last will in the first place fully paid and satisfied and after 
payment thereof and every part thereof I give and bequeath to my son David Cluts 
the sum of one dollar and I give and bequeath to my daughter Susanna 
intermarried with William Meissner* all the residue of my property real and 
personal whatsoever I may have, and if I die before my beloved wife Catharine 
then the same remains with her dowry her natural life, and I do hereby nominate, 
constitute and appoint Wm. Muphree* my executor of this my will and declare this 
only to be my last will and testament, In witness whereof I the said testator 
have to this my last will and testament set my hand and seal the 6th day of 
January A.D. 1858.

Signed, sealed, published and declared by the testator Jacob Cluts as and for 
his last will and testament in the presence of us, who in his presence and at 
his request and in the presence of each other have subscribed our names as 
witnesses thereto

Personally appeared before the Register for the Probate of wills &c in and for 
the County aforesaid David Imler and Daniel Imler, two of the subscribing 
witnesses to the foregoing instrument of writing, who being duly sworn do depose 
and say that they were present and saw the Testator Jacob Cluts sign his name to 
the same by making his mark and heard him pronounce and declare said instrument 
of writing to be his last will and testament, that he desired them to sign their 
names as witnesses thereto and at the time of so doing he the said testator was 
of sound mind, memory and understanding to the best of their knowledge & belief.

Be it remembered that on the 26th day of October A.D. 1858 Letters Testamentary 
were issued to Wm. Masner* Executor in the foregoing will named, he having first 
been duly sworn according to law.
