Huntingdon County, Book 3, page 170

In the name of God Amen I Samuel Wharton of Huntingdon County and Shirley 
township ? advancing in years. Getting frail of body but of Sound disposing 
mind thanks to the ? of Mankind for his mercies thinking it a duty 
encumbered on me to preserve harmony amongst my family after my deceas do 
make this my last will and Testament and hereby revoking any will 
acknowledged by me prior to this date - item 1 I leave and bequeath to my 
son Henry the place that we lately bought of James Jenkins to him and his 
heirs forever - item 2d I leave to my son Samuel the place that I purchased 
from Joseph  ? adjoining Browns land to him and his heirs forever except the 
one half of the meadow on the said place which I reserve for my son James.  
Likewise to my son Saml  aforesaid the place that is known by the name of 
Gilbreat(?) place  to him & his heirs forever - item 3d I leave to my son 
James the place that I now live on with the one half of the meadow alredy 
mentioned as Samuel place likewise the one half of my stock (Horses excepted 
and he is to help Samuel ? a house and barn with what help he can - item 4th  
I leave and bequest to my son John one hundred acres of land to be from the 
NE corner of bills clearing and to extend to a run beyond the frog pond or 
two hundred dollars if he thinks it proper and if he prefers the money the 
place that this one hundred acres is a part of is to be divided so that 
Henry gets the. . .[missing] each of my sons to have the privilege of having 
? wood or hay and the like over the others ? with doing as little damage to 
the ? as the case will require likewise Saml is to have the privilege of 
taking his water from the beach ? by piping or otherwise - and Henry is to 
have the chance of taking in water at cost and of the mountain field viz a ? 
for stock  item 5th  I leave and bequeath to each of my three daughters two 
hundred to be paid three years after my desceas and as my daughter Mary 
Ferrior has been supplied with sons necessaries I allow that two hundred 
dollar to be her full share and my other two daughters Elizabeth & Rebeca is 
to have in adition to the above each one good bed & beding one good cow one 
good bureau & one good saddle.  The cows to - selected from the flock before 
James gets his half - the beds from the house - and as there is a noat of 
Daniel Scecrists in my papers ? I allow it to be put into James hands to 
purchase the other articles mentioned for my two daughters and they are to 
have the privilege of living on this place with James so long as they remain 
single provided they be helpful at harvest and other times when James is 
wanting -  Item 6 and lastly I leave my three Sons Henry James and Samuel to 
be my Executors to Exceute this my last Will and Testament and they are to 
pay equally for ?attening my lands that is to be doa(?) and hay the rest of 
my heirs equally - and equally to paying debts if any and equally all 
expenses that may accue to carry this my last will into affect and further 
if any misunderstand should arise these my Executors each chose one citizen 
neighbor to act in conjunction on the part in dispute and then the majority 
to pay to the minority to be peacible (?) without giving Censor - In 
testimony of the above I hereunto set my hand ? this twenty fifth day of 
March in the year of our lord one thousands eight hundred & twenty two.
