Last Will & Testament of Henry Leee late of Jackson township, deceased

In the name of God. Amen. I Henry Lee of Jackson township, Huntingdon county 
and state of Pennsylvania, being weak in body but of sound mind, memory and 
understanding, do make this as my last will and testament, in manner and form 
following to wit: I bequeath my sould to God who gave it and my body to the 
earth to be buried in a decent and christian-like manner.
Item. I will and bequeath to my beloved wife Christiana Lee, the sum of five 
hundred dollars, to be paid out of my personal estate one year after my decease 
or to her heirs or assigns, also two cows, to be kept for her on the farm on 
which I know reside; also, two beds and bedding, of her own choice; also, one 
cooking stove and one parlor stove; also, the carpeting of the two setting 
rooms & kitchen; also, two hogs each and every year during her life, one to be 
fattened on eeach farm- I alsso give her full control of the mansion house 
where I now reside during her lifetime. I will and bequeath to my wife 
Christiana Lee, the further sum of two hundred dollars, in lieu of dower to be 
paid to her each & every year during her lifetime out of my real estate in  
proportion of each ones share of the real estate.
Item. I give and bequeath to my son James H. Lee & to his heirs and assigns, 
the farm on which he now lives containing one hundred & fifty acres with the 
allowance of six per cent for roads  ?? to wit: all that tract of land north of 
the road leading from McAlevys Fort to Greenwood Furnace known as part of the 
Brown tract & all of the Powell & Black tracts, also part of the Davis tract, 
beginning at the corner near the barn of the said James H. Lee & runnin along 
the Brush ridge line to lands of Liberty Johnsons' heirs including all the 
timber land except ten acres adjoining the said Johnsons' heirs land for the 
use of the farms aon which I now reside; thence to land of Sterrett Cummins; 
thence along the Ebiderrsall tract so as to include the "Hollow Field", or so 
much of it as will make one hundred and fifty acres as above stated; but, 
should there not be a sufficiency, then the balance is to be taken from what is 
known as the "Liberty" field; thence to run parallel with the fence along what 
is known as the "Strass?rfry field" & the "Liberty" field to the public road; 
thence to the place of beginning. It is my will and desire that he shall have 
the fruit off five rows of apple trees in the orchard on the mansion farm for 
ten years after my decease.
Item. I give and bequeath to my daughters Sarah Ann, wife of Marcus Hill & 
Nancy Jane Stewart, wife of Alexander Stewart all the remainder of my real 
estate to be divided equally share and share alike, except that if my wife 
should die first, my daughter Sarah Ann Hill is to have the mansion house with 
the enclosure around the same  over and above her share. And it is my will & I 
so order that my daughter Nancy Jane Stewart is to have use of one half of the 
barn for ten years should the barn fall to that part of the place (by a 
division) on which the mansion house stands. It is my will & I so order and 
direct that should my daughter Sarah Ann Hill die leaving no issue or child 
that her share as above bequeathed to her shall fall back to my estate & be 
equally divided, share and share alike to Anna V. and Fannie K. Lee, daughters 
of my son J.H. Lee, and Adda V. James H. Stewart, children of my daughter Nancy 
J. Stewart. And it is my will that if my daughters Sarah A. Hill & Nancy Jane 
Stewart cannot agree to a division of the real estate bequeathed to them, that 
John Cummins, Samuel Mitchell & John Jackson shall make said division which 
division shall be final and conclusive, & if any or all of the three named 
persons should die or refuse to make said division then it is my will and 
desire that my Executor shall appoint in their place. I also give & bequeath to 
my daughter Sarah A. Hill all the furniture & carpeting in the parlor & the two 
rooms above the parlor (except the settee & the large cushioned arm chair) 
excepting also the carpeting in the 2 rooms above the parlor, which is for the 
use of my wife. I also give to the said Sarah Ann one horse saddle & bridle & 
two cows of her own choice. It is my will & I so direct that after my decease 
that any notes of hand which I hold against Alexander Stewart dated previous to 
A.D. 1866 shall be null & void & shall be given up to him by my executors & 
shall be no charge against ??? in the settlement of my estate.
Item. I give and bequeath to my daughter Mary E. wife of Andrew Smith , of the 
state of Ohio, the sum of five thousand dollars to be paid as follows, two 
thousand one year after my decease, one thousand two years after my decease, 
one thousand dollars three years after my decease, and one thousand dollars 
four years after my decease. The above five thousand dollars is to be paid out 
of my personal estate, should there be a sufficiency, if not, then the balance 
is to be paid by James H. Lee, Sarah A. Hill & Nancy J. Stewart out of the real 
estate in proportion to each valuation. It is my will that after my decease all 
my personal property not already devised shall be appraised & sold & the 
proceeds applied as above ordered. It is my will & I desire that should any 
dispute arise concerning any of the above lines or bequests that the above 
named John Cummins, Samuel Mitchell & John Jackson or their successors shall 
settle the same, and whose decision shall be final, and I hereby appoint George 
Jackson and James H. Lee, executors of this my last will and testament, hereby 
revoking all former wills by me at any time made. In witness whereof, I have 
hereunto set my hand and seal this seventh day of January in the year of our 
Lord one thousand eight hundred and sixty nine

Signed, sealed, published and declared by the above named testator to be his 
last will and testament in the presence of us who at his request and in his 
presence have subscribed our names as witnesses thereunto.

This twenty first day of April A.D. 1869, before me, J.E. Smucker, Register for 
the Probate of Wills and granting Letters of Administration in and for the 
county of Huntindon, personally came J. L. McElvaine & Ruben Ditsworth, the 
subscribing witnesses to the above Will, and being duly sworn according to law, 
did depose and say, that they were present and saw and heard Henry Lee the 
testator, sign, seal, publish, pronounce, and declare the foregoing instrument 
of writing as and for his testament and last will, and that at the time of so 
doing he the said testator was of perfect and sound mind, memory and 
understanding, to the best of their knowledge, observation and belief.

deceased.
