Last Will and 
Testament 
of 
John Freit, Decd.

  In the name of God amen. I John Freit of the Township of Hopewell in 
the County of Huntingdon and State of Pennsylvania being in a declining 
state of health, but of sound and disposing mind and memory (praise be 
God for the same) and being desirous to settle my worldly affairs 
whilst I have strength and capacity so to do, Do make and publish this 
my Last Will and Testament here by revoking and making void all wills 
by me at any time heretofore made and first and principally I comit my 
soul into the hands of my Creator who gave it and my body to the Earth 
to be interred in a decent manner at the discresion of my Executors 
herein after named and as to such worldly Estate wherewith it hath 
pleased God to entrust me with I dispose of the same in the following 
manner viz.-- First I order all my just Debts and funeral expenses to 
be paid and satisfied, Then I give and bequeath to my son Henry Freet 
five shillings lawfull money to be paid unto him in full for his share 
of my real and personal estate- Item I give devise and bequeath to my 
Daughter Mary Freet now Mary Gardner all my Real Estate and all the 
remainder of my personal estate after my just Debts funeral expenses 
and five shillings to Henry Freet are all paid the personal estate to 
be divided between her and her children as after mentioned-And lastly I 
nominate and appoint my Friends Matthew Gardner and George Brumbaugh 
Executors of this my Last Will and Testament. It is further my will 
that at my Decease I direct all my personal Estate to be equally 
divided between my Daughter Marry Freet now Mary Gardner and her 
Children She retaining one third thereof and the children share and 
share alike to be divided between, as they may mutually agree but in 
case they cannot agree on such a division it is to be left to two or 
three men chosen by the parties to make said distribution and it is 
further my will and I hereby direct that at the decease of my said 
Daughter Mary now Mary Gardner that my Real Estate be equally divided 
between her children share and share alike to be divided between them 
by their own concent and agreement but if they cannot agree on such 
divisions to be divided by three men mutually chosen by the parties or 
their representatives which division shall be final  and Conclusive 
between the parties. In Witness whereof I have hereunto set my Hand and 
Seal this tenth day of September one thousand eight hundred and twenty 
two - 

The personal Estate to be divided between her and her children as after

  Before me Richard Smith Register for the probate of Wills and 
granting Letters of Administration in and for the said County of 
Huntingdon, personally appeared Samuel Brumbaugh one of the subscribing 
witnesses to the foregoing Instrument of writing who upon his solemn 
affirmation saith that he was personally present and did see and hear 
the Testator John Freit Sign, Seal publish and declare the foregoing 
Instrument of writing as and for his Last Will and Testament and that 
he the said Samuel Brumbaugh did subscribe his name thereto as a 
witness in the presence of the Testator and at his Instance and request 
and that the said John Fried the Testator was at that time of sound and 
disposing mind and memory to the best of this affirmants Judgment and 
Belief -

  Before me the Register for the probate of Wills and granting Letters 
of Administration in and for the County of Huntingdon aforesaid 
personally appeared James Entrekin Esquire one of the Subscribing 
witnesses, to the foregoing Instrument of writing who upon his solemn 
oath saith that he was personally present and did see and hear the 
Testator John Fried Sign, Seal publish and declare the foregoing 
Instrument of writing as and for his Last Will and Testament and that 
he the said James Entrekin and Samuel Brumbaugh the other subscribing 
Witness did subscribe their names thereto as witnesses in the presence 
of the Testator and at his Instance and request and in the presence of 
each other and that the Testator John Fried was at that time of sound 
and disposing mind and memory to the best of this Deponents Judgment 
and Belief -

Memorandum
  Letters Testamentary in the Estate of John Fried Decd. were this Day 
granted to Mathew Gardner and George Brumbaugh. Inventory to be 
exhibited on or before the 11th day of December next and a tried and 
Just account calculations and reckoning of their said Administrators on 
or before the 11th day of November AD 1823 or when thereto legally 
required -
