Written: August 17, 1866

Last Will and Testament of Benjamin Briggs late of Tell Township.

Know all men by these presents that I Benjamin Briggs, late of Tell 
Township, Huntingdon County, Pennsylvania, farmer being in ill health 
but of sound and disposing mind and memory do make and publish this my 
last will and testament hereby revoking all former wills testament at 
any time heretofore made.  And as to my worldly estate, and all the 
property real and personal, or mixed of which I shall die Seized and 
possessed, or to which I shall be entitled at the time of my death.  I 
devise, bequeath and dispose thereof in the manner following to wit.  
First my wish is that all my just debts and funeral expenses shall by 
my executor hereafter named, be paid, out of my Estate; as soon after 
my decease as shall by them be found convenient.   Item. I give, devise 
and bequeath to my beloved Son John my three work horses together with 
an Equal Share in common with my Son William of all my personal estate 
or effects.  After deducting my two colts, which I hereby give and 
bequeath to my Son William, the two boys named, to have and to hold all 
the personal property, share and share alike, with the exception 
mentioned.  Also my two Sons John and William are to settle all my 
debts and pay them in consideration of the personal property,  All 
being held by them and lest my personal effects are insufficient to do 
this, in Justice to the boys,  I do hereby give and bequeath further to 
my Sons John and William, share and share alike, all the tract of land 
on which John Creuin now resides, consisting of one hundred acres of 
land, more or less, with all appurtenances.  This I desire, shall be 
put to sale as soon as convenient and desire and command that out of 
the proceeds of said sale, John and William shall pay to each of my 
three daughters namely, Rosanna, Mary Ellen and Margaret, one hundred 
dollars in such property as the said girls may choose.  So as to make 
them equal with my daughter Hannah Parsons who I gave about that amount 
of property at her marriage.  I with that in consideration of this, as 
in above mentioned, and the personal property named being devised to 
the boys.  That they shall furnish a home at their house for the girls 
till they are married, and that my children all live together while 
they are single, and after four years subsequent to my decease.  I give 
and bequeath to my daughters Hannah, Rosanna, Mary Ellen and Margaret, 
each the sum of two hundred dollars, to be paid them in annual 
installments of Fifty Dollars.  Item, the which sum is paid the first 
payment as named above four years after my decease; and on condition 
that my sons John and William pay the said bequest last named to the 
girls mentioned then in that case and that only I give and bequeath to 
the said John and William All my farm and its appurtenances, on which 
Oliver Parson now resides.  To have and to hold the same for their own 
use and behoof forever - but in case my sons John and William should 
fail, neglect or not use to pay the bequest there by.  Two Hundred 
Dollars to each of my four daughters named above.  Then it is my wish 
that the said property should be put to sale and the proceeds among all 
my six children.  Share and share alike Lastly I do nominate and 
appoint James G. McClure and my Son John to be my executors: of this my 
last will and testament.  In testimony whereof I the said Benjamin 
Briggs have to this my last will and testament contained one sheet of 
paper subscribed my name and affixed my seal this seventeenth day of 
August the year of our Lord Eighteen hundred and Sixty Six.
