Anniston Hot Blast January 22, 1908
Arrested for Moonshining. W. S. Smith, J. W. Morrison and Will McDowell, all of 
Clay County, were tried before United States Commissioner Randolph yesterday 
afternoon for conducting an illicit distillery. The men were brought here 
Wednesday by United States Marshal Hill, and a temporary bond was made for their 
appearance in court yesterday. The witnesses testified that Smith and Morrison 
were connected in conducting a still on Millshole creek, in October, but no 
evidence was given of McDowell's connection with the distillery, and the charge 
against him was dismissed. The evidence goes on to show that the still was 
located in the side of a small bluff on the creek and about a mile from any 
house and that beer and whiskey were made. One of the witnesses stated that he 
was hauling pine from around the place and at one time went to the still and 
could see no one, but Boon located the beer, and as straws were convenient be 
proceeded to help himself. Before and after that time he said he had seen Smith 
and Morrison at work there. Another witness stated that he overheard the men 
talking one night and watched them work. It was also stated by some of the 
witnesses that Morrison had sold some of the whiskey. The defendants, of course, 
claimed they had nothing to do with the still and knew but little about it. 
Smith was bound over to the grand jury of the United States court on a $300 
bond, and Morrison was bound over on a $100 bond. As soon as the trial was over 
Mr. Hill rearrested Morrison for selling whiskey, and a temporary bond of $100 
was made for his appearance in court January 25th before Judge Randolph.
