The Executor reports that he and his wife, child & children have been living with the family of the decd that his wife is an heir of said decd and that the family supplies have with some few exceptions been charged to the Estate but that in lieu of board he has not charged the Estate with commissions, nor has he made any charge for services rendered said Estate. He also asks the permission of this Court to compromise a debt due to H. Kendal Carter & co amounting to some 5 or/ $6000 by deeding to said parties [blank] acres of land. He reports further that he did not sell under order of Court granted him the lands belonging to the Estate of decd to pay debts & c. Because he state that after having obtained said order he had an interview with the attorney of Miss H. Kendall Carter & co. and learned from him that for about one fourth of the land to be sold he could compromise the debt held by said f… believing it to be to the interest of said Estate to v… the c…

withheld from sale said lands believing at the same time that should a sale be made the section tract of land would not more than sell for the amount of the debt in question. Whereas to make the compromise would leave about 1080 acres with 200 acres in cultivation and best find property debts to be paid.

On the 12th day of January 1861 the plaintiff filed before on a note against defendant whereupon a summon issued to Constable of Carter Township returnable 19th of January 1861. The debt $150.00 Damages $23.65. Justice for $390 C… L… $100

Was returned executed on J.W. Haley and this cause is continued with an alias returnable 16th of Feby 1861.
On this the return day of the writ which was retuned executed having waited three hours thereafter the defendant came not but makes default.
This action is founded on a note as follows: To wit:
$100.00 On or before the first day of January 1861 we or either of us promise to pay Andrew E. Jackson or bearer one hundred dollars, value received, with ten per cent interest from date. October 13th 1858.

Moore, Esqr for collection and the said Denson requested the admrx to pay said Moore in Confederate money and my agent presented Two Hundred & ninety four dollars to said attorney and he refused to receive Two hundred dollars of it. Therefore the Admrx crave allowance for the $200. And credit on the demand of said Denson as useless the same money in this Acct Current.

All of which lands were divided by themselves all having attained their majority. This administrator states that the Federals during the month of Feby of 1865 destroyed the vouchers from No 4 to No 17 also the following notes Mr. Gennfre $70.00, Rhodes $34.00 … of which was entirely worthless when this came to his hands. He has in his hand one note on W.J.A. Bell for $156.89 which is banned by the statute of limitations and worthless. There are some claims for fees as Clerk of Ashley Co. for a considerable sum but considered worthless.
